The Association would prefer not to grant an additional easement over its common
elements if it could be avoided. While we can appreciate your concern about installing a water
main near electrical lines, the Association requests that the existing utility easements be used as
much as possible for the water main.

SUBJECT: Utility Easement for Water Main Installation at the
Southwest Corner of Sebastian Lakes Condominium
Development
As of Monday, March 7, 1994, Mrs. Virginia Zahn, President of the
Sebastian Lakes Condominium Association, informed me that she would
have a letter written to the City granting a utility easement to
the City as requested, but subject to the review and approval of
the Association's attorney.
Following your directive at this morning's staff meeting to write
a memo on this subject. I called Mrs. Zahn at 11:15 a.m. to learn
when I could expect the letter. Mrs. Zahn informed me that new
elections for Association Board Members were held yesterday and
that all new members were elected. She told me that to protect the
Board from liability, she now requests, again, a letter from the
City informing the Association Board that the City will evoke its
right of eminent domain powers to acquire the easement. I told
Mrs. Zahn that I had already discussed this approach with you and
neither one of us want to threaten Sebastian Lakes with legal
action to obtain an easement. We would prefer to acquire the
easement through more amicable means.
Mrs. Zahn told me that the only other alternative was to have the
Board issue ballots as to whether or not the Association could
grant an easement. This process may take three or four weeks to
complete, since the people do have the right in their Association
rules and regulations to vote on granting an easement.

I told Mrs. Zahn that I had written a letter to the pastor of
Christ the King Lutheran Church committing the City to provide
water to the Church in the future. I explained that the City was
in the process of trying to obtain a utility easement from
Sebastian Lakes and could not guarantee when this would
materialize. I told Mrs. Zahn that my letter would enable the
Church to receive approval from the Indian River County
Environmental Health Department to use its irrigation well as a
temporary water supply until such time as the City installs the
water main. Therefore, since the Church could be temporarily
served water by its own system, I preferred that the Association
take a vote of their members as soon as possible rather than the
City issuing a threatening ultimatum involving eminent domain
action.

Dear Rev. Hauenstein:
As per our previous discussions, the City intends fully to
provide water service to your new church being constructed at 1301
Fellsmere Road in Sebastian. The City's plan is to tap the
existing 8" water main between Buildings 6 and 7 in the Sebastian
Lakes Condominium development, run a water main through the
development, and along the south side of Country Road 512 to the
east corner of the church property where a meter will be set. On
February 9, 1994, the Sebastian Lakes Utility Company entered into
an agreement with the City to convey its existing water and sewer
systems within Sebastian Lakes to the City. Unfortunately, the
easement which the City needs to construct the water main must be
granted by the Sebastian Lakes Condominium Association. As you
know, I met with the general membership and Board of Directors at
their meeting on February 22, 1994. To date, I have not received
any favorable news about the Association granting the easement.
The City may have to resort to possible legal action to procure the
easement. Needless to say, I cannot predict how long this will
take but the City shall persevere since the City has committed to
providing potable water to your Church.

The proposed project consists of extending an 8" water along the southern boundary of Sebastian
Lakes and continuing along County Road 512 with a 2" line to the United Church of Christ. The
8" line is proposed to be installed in a utility easement obtained by you from the Sebastian Lakes
Condominium Associates. There will be one ditch crossing along County Road 512.

Dear Barbara:
I have attached a copy of the sketch of the subject easement
that we discussed with City Attorney Charles Nash yesterday in the
course of our conversation about the Water and Wastewater Service
and Contribution Agreement. I spent time on site yesterday in
determining the routing of the easement and approximate dimensions.
The purpose of the easement would be to provide for a future
installation of a water main within County Road 512 to serve two
churches and a small undeveloped lot west of Sebastian Lakes and
south of County Road 512.
I have routed the easement to minimize the disturbance to the
existing residents. The majority of the easement will be adjacent
to the. south property line of Sebastian Lakes along which an
electric powerline now exists. Approximately 200 feet north of a
15 foot wide utility easement would be located on the north and
west side of Building No. 7. Only an irrigation system, yard
lighting, and a small three foot wide concrete walkway would be
affected by installation of a water main within the easement. The
City, of course, would repair the irrigation system, lighting
system, and walkway if damaged, and would replace all disturbed
areas with sod at the time of construction of the water main.
For a metes and bounds legal description, the City would
engage a licensed surveyor. My interest at this time is to have
assurance from Sebastian Lakes that the easement will be granted to
the City in`the general location shown, with the actual bearings
and dimensions to be determined later.

SUBJECT: Meeting in Regard to Supplying Water to Customers Along
CR 512 and Roseland Road on Certain Portions Within the
City Limits
I presented my case before the group, citing reasons why the County
ought to service the area. See the attached copy of my December
23, 1993 memo to Kay O'Halloran. After much discussion, the
outcome of the meeting was that the City should not relinquish any
more of its service area to the County. Therefore, the City will
not request the County to service those customers along the CR 512
and Roseland Road corridors. Dan suggested running a 2" water main
down CR 512 to serve the churches from coming off the water main
inside Sebastian Lakes. I informed the group that at this time,
the City does not own the water lines in Sebastian Lakes. The City
is in the process of finalizing an agreement for the Sebastian
Lakes condominiums to acquire the water system, but the City only
owns up to the meter on Laconia Street. Dan suggested that we
engage the engineer for Sebastian Lakes at this time to design the
water system to serve the churches along CR 512, since they are
working on the as-builts for Sebastian Lakes. I didn't want to get
into a conflict of interest by having the City work with the
engineers for an entity the City is currently negotiating an
agreement with. I told Dan I would be more comfortable is using a
local engineer to design the system and permit it.
I was able to reach Reverend Paul Hauenstein on January 12, 1994 at
11:30 am. to inform him of the status of the above.

SUBJECT: County vs. City Water Service for Portions of CR 512 and
Roseland Road within City Limits
Indian River County has previously installed a 16'" water main
within the County Road 512 right-of-way west of Roseland Road and
within the Roseland Road right-of-way north of County Road 512.
The City does not have any water mains within either corridor and
most probably won't have water mains in this specific area for many
years to come. If possible, duplication of water mains within
these corridor segments should be avoided to avoid the potentiality
of tapping the wrong main in the future.
Representatives of Christ the King Lutheran Church have expressed
a desire to connect to the County water main rather than install
their own treatment system on their site. Christ the King Lutheran
Church is in the beginning stages of constructing a new church
building on County Road 512 on the west side of Roseland Acres
subdivision. The Church could easily tap the County's 16" water
main, if permission were obtained. However, the County has no
jurisdictional rights within the City's boundaries to allow taps
from City customers. There is no agreement for the County to serve
City customers with water other than the Interlocal Agreement to
serve water to Wal-Mart.
All total, two churches within Roseland acres, a small triangular
lot west of Roseland Acres, and 119 residential lots along Roseland
Road (including 22 lots in Point -O -Woods Subdivision) could connect
to the County's water main now and the City could avoid the
construction of duplicate water mains sometime in the future. The
City could enter into an "Interlocal Agreement", such as it did
with Wal-Mart North, so that the County's service territory could
include only the above named lots. I have enclosed a map showing
the specific lots the County could serve.

It may be possible to have the City serve the two Churches and
triangular lot west of them if a water line was installed from
Sebastian Lakes once Sebastian Lakes conveys its water mains to the
City. Easements from both churches would have to be obtained.
As you suggested in early December, we should have a meeting to
discuss this matter which would involve Dan Eckis, City Engineer
and Marilyn Swichkow, Finance Director. Since Dan will be out of
town until January 3, 1994, I would suggest a meeting be held
during the latter part of that week, possibly January 6 or 7.
Please inform me as to when it would be convenient with your
schedule.

RESUME OF CONVERSATION: I called Reverend Paul Hauenstein of
Christ the King Lutheran Church and told him that the Interim City
Manager, Kay O'Halloran; Finance Director,, Marilyn Swichkow; City
Engineer, Dan Eckis; and I would try to meet within the next two
weeks to discuss relinquishing the City's service territory for
portions of County Road 512 and Roseland Road. I explained to him
about the meeting Kay, Marilyn, and I had with the County on
October 14th to discuss providing water to Wal Mart. At the same
meeting, I had presented my "Report on Water Demand for Potential
Customers Along the Existing Indian River County Water Main Lying
in the CR512 and Roseland Road Rights -Of -Way". However, the group
did not discuss it because Marilyn Swichkow, Finance Director, did
not want to address it at that time. Wal-Mart was a major
consideration at the time because it had political ramifications if
water couldn't be provided to it by the City or County.
I told Reverend Hauenstein that Council would have to become
politically involved in the expansion of the County's service
territory along CR 512 and Roseland Road as well.

REPORT ON WATER DEMAND FOR
POTENTIAL CUSTOMERS ALONG THE EXISTING
INDIAN RIVER COUNTY WATER MAIN LYING IN THE CR 512
AND ROSELAND ROAD RIGHTS-OF-WAY
Indian River County has installed a 16" diameter water main
along those portions of the north side of County Road 512 (CR 512)
and west side of Roseland Road rights-of-way within the Sebastian
City Limits (see attached map). Currently, the City of Sebastian
does not have any public water distribution system within either
corridor to provide service to adjacent properties. Only the
adjacent Sebastian Lakes Condominium Development and the North
Indian River County Library are presently connected to a public
water supply system. They are served by the General Development
Utilities water system through a connection on Laconia Street.
Representatives from Christ the King Lutheran Church have made
a request to the City of Sebastian that they be allowed to connect
to the existing County water main. The Church has a site west of
Roseland Acres residential subdivision on the south side of County
Road 512 west of the southerly entrance of San Sebastian Springs.
The Church plans to start construction in the near future. The
engineer for the project, Mosby and Associates, Inc. has determined
that the Church will have an estimated sewage flow of 780 gallons
per day. If the sewage flow is estimated to be 85% of the water
demand, the water demand would be approximately 920 gallons per
day. Of course, the only time during the week when maximum demand
would occur would be on Sunday.
Lots 1 through 6 within Roseland Acres Subdivision are
immediately adjacent to the south side of CR 512. Lots 1 and 2 in
Roseland Acres Subdivision are undeveloped. The existing United
Church of Sebastian occupies lots 3 through 6. Currently, the
Church has its own individual water system on site. The sewage
flow is estimated to be 450 gallons per day. Water demand as
calculated above would be 530 gallons per day.
All other property lying within the Sebastian City limits and
adjacent to the County Road 512 and Roseland Road consists of
previously platted residential lots. Those lots that are adjacent
to the CR 512 corridor within the San Sebastian Springs Subdivision
are lots 123, 124, and 147 through 154 for a total of 10 lots.
Lots that are adjacent to the CR 512 corridor within Unit 5 of
Sebastian Highlands are Lots 18-49 in Block 169 for a total of 32
lots. All of the aforesaid lots are separated by the 100 foot wide
right-of-way that was formerly the Trans -Florida Railroad right-of-
way. However, the railroad right-of-way has been purchased by
Indian River County to expand County Road 512. The existing 16"
diameter water main is located approximately 10 feet to the north

of the existing CR 512 pavement. Therefore, services from the main
would have to run approximately 140 feet to all of the residential
lots along the north side of CR 512.
Along the Roseland Road corridor, there are 38 lots adjacent
to the right-of-way in Unit 5, 35 lots in Unit 4, and 24 lots in
Unit 3 for a total of 97 lots in the Sebastian Highlands
development.
Although the Shiloh Youth Ranch is shown to be within the
boundaries of the City Limits, the City believes the map to be in
error and that the property is actually within Indian River
County's territorial jurisdiction. The last residential properties
within the City Limits adjacent to the Roseland Road right-of-way
are located in Point -O -Woods Subdivision, which consists of 22
lots. A water distribution system would have to be constructed
within the subdivision to supply water to all of the individual
lots.
The total potential customers located immediately adjacent to
the County Road 512 and Roseland Road corridor are as follows:

In summary, the CR512 and Roseland Road corridors have the
potential for 52,000 gallons average daily flow that can be served
by Indian River County from its 16" diameter water main.
The City recognizes that it must enter into an agreement with
Indian River County for the purchase of water at bulk rates.
Currently, the April 21, 1992 Interlocal Utilities Agreement has no
provisions for the sale of bulk water from the County to the City.
The Agreement only provides for bulk wastewater rates for
wastewater service that Indian River County provides City
customers. Therefore, an analysis must be done of the cost for
Indian River County to provide bulk water treatment and
transmission of service, and to develop rates to recover the costs

for providing water to the City. Both the base facility charge and
volume charge for water must be analyzed. Until the analysis is
done, and both Indian River County and the City of Sebastian must
approve an agreement for the sale of bulk water by the County to
the City, the County has no legal authority to sell water to the
City of Sebastian.

submit a formal application, including payment of
any utility ERU and/or hook-up fees required in the
matter.

SUBJECT: Christ the King Lutheran Church on CR 512
RESUME OF CONVERSATION:
Dave wanted to know if I would mandate the Church to connect to the
County force main. I told him that since the Church was small and
met infrequently (Sundays and possibly Wednesdays), I could not see
the need for the Church to connect to the County force main. A
septic tank and drainfield would certainly be sufficient for
occasional use of the building. The cost for a septic tank and
drainfield would probably range between $2,000.00 to $3,000.00,
whereas a small commercial type duplex lift station would cost
between $18,000.00 and $20,000.00. Dave asked what the ERU's and
charges would be. I quoted the 1993 rates from the Rate
Resolution. After hearing the costs, Dave thought that the septic
tank would be the most reasonable alternative. I told him to call
Director, Mike Galanis or Assistant Director Glenn Schuessler at
the Indian River County Environmental Health Department to discuss
installation of a septic tank and drainfield in lieu of connecting
to county sewer.
Dave wanted to know about connecting to County water. I reiterated
to Dave the gist of the meeting Robb McClary and I had with Terry
Pinto and Harry Asher on May 25, 1993. I would have to present a
small study or report to the County Utilities Department, which in
turn would have to go before the County Commission for approval.
Terry Pinto told Robb and I that the Sebastian City Council said
the County should not sell water inside the City limits. I told
Dave that Robb stated the County didn't have water mains installed
in Sebastian at the time the Interlocal Agreement was signed.
Therefore, water wasn't included in the Agreement. I told Dave
that I might have Oksana Fung (an FIT student who Dave put me in
contact with) undertake this study. In any event, no decision from
the County would be coming until 2 to 3 months from now.

RE Meeting with Terry Pinto, Robb McClary, City Manager, and
Harry Asher of Indian River County Utilities Dept with
reference to water service to Sebastian residents and
businesses along Roseland Road and CR 512 - Corridor and
North US #1 Corridor
Rich explained the memos from Dave Fisher and Bill Caldwell. Terry
explained that the City Council didn't want Indian River County
to serve the Sebastian customers. Terry said that the County had
to downsize its water system. Robb said that initially, at the
time of the agreements, the issue of water service was moot. The
County had no water in the Sebastian area. Terry said that there
may have been some sort of misunderstanding. He made it a point to
the County Commissioners that City didn't want water in the
agreement. He said that the County spent a ton of money downsizing
its water system in the North County since the County was no longer
servicing the Sebastian area. Both plant capacity and land size
for the plant were reduced. The County allows any water main to be
serviced; therefore, the County main on Roseland Road can be tapped
to serve residences along the corridor.
Rich said we're looking at a small number of customers who will
connect to the water main along Roseland Road and County Road 512.
Terry said that the County is now borrowing water from south county
to feed the north county. The North County water plant will be
built at 3 MGD. Terry suggested that we figure out what we want
such as connections, gallonage, service area, etc.
Terry wanted to know what our time period was. Rich told him that
it was unknown, but possibly, three years before water can be
provided. Terry recommended to have Rich Votopka put together a
proposal for the County Utilities Department and the County
Commission.
