This schedule should include the installed costs for the wells and water treatment plant at Park Place, water distribution systems for both Park Place and Palm Lake Club, and gravity sewer collection systems for both developments. It is my understanding that a 10" trunk line gravity sewer which is routed through Palm Lake Club, and the lift station and force main which serves Park Place and Palm Lake Club will remain as property of Indian River County and will not be transferred to the City of Sebastian. I would like to schedule a meeting with you at your earliest convenience. We must determine the specific water and sewer systems components to be transferred to the City, so there is no misunderstanding between the City and County when operation of the systems becomes the City's responsibility on May 1, 1993. Utilities Director RBV/ar cc: Robb McClary, City Manager Marilyn Swichkow, Finance Director TECHNICAL INFORMATION ON THE PARK PLACE WATER TREATMENT PLANT March 22, 1993 1) The west well consists of a 6" diameter galvanized steel casing with a 3" diameter PVC drop pipe. It has a Goulds Catalog No. SPB15035 pump (Serial No. 1659721) with a 5-5/16" diameter impeller manufactured in June 1989. The pump has a 5 HP, 3 phase, 240 volt Baldor Motor. The pump has a 2" PVC discharge pipe. 2) The east well consists of a 4" diameter galvanized steel pipe casing with a 2" drop pipe. It has a Transamerica Delaval Model No. 50SPLZ3P pump manufactured in Dayton, Ohio. The pump has a 5 HP, 3 phase, 3480 RPM, 240 volt Magnatech Electric Motor (Part No. 6-36-324-01) Model No. SPBF4. The pump has a 2" galvanized discharge pipe. 3) The east and west wells operate from "sensitivity floats". One well can operate independently of the other. There are three (3) taped settings in the clear sight glass for the ground storage tank. The sight glass is located in the southeast corner of the plant's control room. The sight glass is marked as follows: SHUT OFF WEST WELL (Primary) ON EAST WELL (Backup) ON The east well only comes on when the west well can not keep up with the demand. 4) The plant is classified as a Category III, CLASS C, 100,000 gallon per day plant which requires an operator three days per week, 1/2 hour check minimum each time. 5) The chlorine room is a small, white fiberglass shed which is located at the northeast corner of the plant. It contains a Pennwalt Scale with adjusting nuts on the top. The scale holds two 150 lb. chlorine cylinders. There is one Regal gas chlorinator (or rotameter) which sits on the top of the cylinder being used. A cylinder is used about every 20 to 30 days. The injection tee is housed in a meter box. In keeping with the terms of our standard contracts with the City of Sebastian, our firm agrees to perform the following services to operate the Park Place Water Treatment Plants Operation of one Category III Class C (100,000 GPD) Water Treatment Plant will be on a three (3) day per week (Monday. Wednesday, and Friday) on-site inspection basis in accordance with the directives as outlined in Florida Administrative Code Chapters 17-550,555, 560 and 602. The $777,000 represents water distribution system, plant, and wells, gravity sewer collection system, and one lift station and force main within Park Place itself. It does not pertain to any real estate such as the property the water plant is situated on. The City has the right to have the use of the water plant property for ten (10) years but then has to pay fair market value for it to Nelson Hyatt if the plant is operational beyond that time peri- od. 9) Ask Harry for the original Consumptive Use Permit for the well at Park Place Plant and DER Permit. May 3, 1993 TRANSFER CEREMONY of THE PARK PLACE PLANT OPERATIONS from INDIAN RIVER COUNTY to THE CITY OF SEBASTIAN The following is a prepared text which was written by Richard B. Votapka, Utilities Director, for an oral presentation at the Transfer Ceremony held at 10 AM, Monday, May 3rd at the Park Place Water Treatment Plant. Rich Votapka first welcomed everyone present and then delivered his oral presentation based on the text below: Today marks an historic day in the City of Sebastian. It represents the entry of the City into the operation and maintenance of its first municipal water supply and distribution system. Although it is a small system consisting of 164 customers in Park Place and 20 in Palm Lake Club, it never the less is a beginning. It brings to mind the time I had started work 16 years ago in 1977 for Beindorf and Associates. The firm at that time was engaged in joint co-operation with Sverdrup and Parcel in working for Indian River County in the renovation and expansion of the water system in the Gifford area. I spent two years working with Leon Young, Supervisor of Customer Service of Indian River County Utilities in order to upgrade the old UDU (Urban Development Utilities System) to bring good, potable water to the residents of Gifford. Now after 16 years later, I am again working with Leon Young, in starting out on a small segment of the City of Sebastian's future large municipal system. The 200 residents we will serve today will grow into 22,000 by the year 2005 according to the demographic projections. Currently, the City is negotiating with GDU, which, if negotiations are successful, could catapult us into having a system of approximately 1400 customers by mid -summer. Today, however, we want to recognize the joint spirit of co- operation between the County and the City leading up to this event. I thank all of the many personnel and staff of the Indian River County Utilities Department who have been so helpful to me in furnishing me with information and showing me many things in the field that I need to know to get started. I really appreciate them for their efforts and am deeply grateful. I know that the turn of events which led us here today have taken place over a considerable amount of time. So at this time, I'd like to afford an opportunity to others who may wish to say a few words about this historic occasion. Page Two of Two May 3, 1993 TRANSFER CEREMONY As a symbol of Sebastian's takeover of operations of this plant from Indian River County, I will attempt to place the official seal of our City over that of the existing County's seal on the door of the plant. This will signify the change being made here today. I want to thank each and everyone of you for attending this small ceremony and invite you for a cursory look at the interior of the plant if you'd care to have the opportunity. Utilities Director MEMO TO FILE DATE May 10, 1993 FROM Rich Votapka, Utilities Director RE Park Place Water and Sewer Systems I met with Steve Pitiak at 11:40 AM to 3:00 PM in my office. He contends that the company broke the original agreement because of; 1) Nash made a statement that the City didn't have a valid reason to transfer the franchise. Steve is saying that Indian River County should have transferred all of the franchises back to their original owner including Park Place. Steve said originally the City granted a franchise to the Village of Lake Dolores. Once that was sold to the Park Hill Brothers, the franchise was transferred. Park Hill Brothers faulted, the judge ruled that Nelson was entitled to regain the utilities back. According to Steve Pitiak, Nelson Hyatt violated a state law by signing an agreement with the County Chapter 723 by not notifying the Homeowner's Association 90 days prior to executing the agreement of the impending sale of the utility. By not notifying the Homeowner's Association by law, no one knew that the utility would be sold. In the advertising by the County in the Press Journal under legal notices in July 1989, the County did not put the full name of the utility in the paper. It said "Village of Lake Delores" (spelled Dolores). It should have read "Lake Delores Utilities and Cable Television Systems, Inc. Water and Sewer." Steve is saying that State Law requires use of the full name. No one from Park Place showed up at the Public Hearing held on July 11, 1989, at the County Commission Chambers. On June 9th and 16th, 1989, the Notice to the Public was published. Individuals in Park Place were not notified by mail or any other means. Neither was the President or offices of the Homeowner's Association. Approximately one month notice was given, not the required 90 days. Page Two of Two May 10, 1993 Memo to File Meeting with Steve Pitiak Re: Park Place Water and Sewer Systems 2) The City of Sebastian is the original franchise. There was never a public hearing held to transfer the franchise for Lake Dolores; no appraisals were determined to find out the value of the utility although $777,000 is stated in the Takeover Agreement. Steve asked "Can we legally charge Park Place a $10 surcharge for the water/sewer system without charging the residents of Palm Lake Club for using the system?" I asked Steve about the agreement with Palm Lake Club. Steve said the County entered into agreement with Fischer to pay him approximately $48,000 to oversize the water and sewer mains for future development. The County would reimburse them by paying to them 1/2 of the impact fees. The surcharge was for water and sewer. Steve's recommendation is to leave out the $10 surcharge in the Resolution. He said that if " I was insistent, then he and several of the residents will go around the City and fight it." He wanted me to ask the Finance Dept. and City Manager if the Resolution Amendment in regard to the $10 surcharge can be temporarily withdrawn from consideration by Council until legal clarification is received. (Marilyn and Robb said "No".) Steve wanted me to ask the City Attorney if the Interlocal Agreement is still valid since the County did not turn over the Sewage Treatment Plant to the City. (Charley Nash said it was valid.) Steve wanted me to check with City Clerk as to Exhibit "A" in the Nelson Hyatt agreement. (I found Exhibit "A" in the City Attorney's files after consulting with Sally Maio)." Steve reiterated several times to tell me not to proceed with showing the $10 surcharge on the Resolution. He said the residents would pay this regardless of whether the surcharge was included in the rate resolution or not. Our meeting ended at 3:00 PM. I told Mike that I was trying to locate a portable trailer mounted generator to service the 100,000 gal/day Park Place Water Treatment Plant. The plant has two 5 HP well pumps and two 20 HP high service pumps. The total watts I calculated were as follows: 2 - 5 HP pumps = 10 HP 2 - 20 HP pumps= 40 HP TOTAL 50 HP x 750 watts/HP 37,500 watts (Round up to 40 kw) Mike said to use a multiplier of 2-1/2 times the amount of the total horsepower. Therefore, 2-1/2 x 40 kw = 100 kw. Mike said that he did not have a portable generator that size and could not help us. He suggested that I call GRECO in Orlando. Florida and speak to Scott Telford.
