Currently, both systems are independent of each other being served by their own plant. There will be no change in the sampling points for Park Place and Palm Lake Club. A sample is taken each month on the north side of the system at the Palm Lake Club Clubhouse and on the south side of the system at the Park Place Clubhouse. Sampling at both locations will continue unless your office otherwise directs our Department to take samples elsewhere. In the Sebastian Highlands system, eight (8) bacteriological samples are being taken each month. As per our discussion, timing of the samples is not a factor and the frequency can remain at once per month since only four (4) samples are required fo.r the present population on the system. I have enclosed a map of the present Sebastian Highlands water distribution system dated October 21, 1994 showing the eight (8) sample points presently used. There are five (5) critical sample points which are located at the, extremities of the system. These are to be sampled once per month in lieu of being rotated. Wetherell Secretary This will confirm a visit to the subject community public water system on August 10, 1994, by Bhanu Engineer and Debra Laisure of this office in the presence of Ron Briskie and Tom Stirtzinger for the purpose of conducting a sanitary survey. A copy of the report is enclosed for your reference and records. Deficiencies noted during the survey and/or determined from records on file in this office are indicated below including the cited rules of the Florida Administrative Code (F.A.C.). Deficiencies 1. Compliance monitoring shall be conducted for the contaminants listed below. A minimum of one sample shall be taken at every entry point to the distribution system that is representative of each source after treatment (unless otherwise noted below) and submitted to an approved laboratory, and this Department notified of the date of submittal and the laboratory name no later than fourteen days from your receipt of this letter. You must submit a copy of the laboratory results to this office upon your receipt of such from the laboratory. Unregulated organic contaminants (VOCs): [Rule 62-550.521, F.A.C.] Group I UOCs - four consecutive quarterly samples for the six (6) new chemicals in this group were required in 1994. The first two quarters are past due. Begin sampling this quarter, and roll into 1995. Repeat monitoring in future years is not required. Credit has been given for samples taken in 1991. A written sampling plan for total coliform shall be available for review on the occasion of a sanitary survey conducted by the Department. The plan shall address location, timing, frequency and rotation period of total coliform sampling collection to determine compliance with Rule 62-550.310(4),F.A.C. Descriptions of sampling locations shall be specific, i.e. numbered street addresses or lot numbers. Pressure tank and plant tap samples are not acceptable for determining compliance. [Rule 62- 550.518 (1), F.A.C.] 3. In accordance with Rule 62-555.330, F.A.C., the following appurtenances for the pressure tank/ground storage tank package plant are required to be provided for proper maintenance and control: a. Sight glasses for both tanks must be cleaned. b. Air release valve(s): must be screened in order to provide proper protection from insects and other contaminants. c. Repair the broken overflow pipe on the ground storage tank. d. Provide information on the normal range of operating pressure for the system. e. The package plant exhibits some rust. Clean and inspect the tanks and repaint them. 4. There was a lack of safety and control equipment for chlorine gas use. In accordance with Rule 62-555.320(5), F.A.C., the following items are required: a. A bottle of fresh ammonia solution to test for chlorine gas leakage b. Sufficient spare parts and lead washers for the chlorinator available on site to provide expeditious repair in case of failure. c. An adequate reserve supply available on site. d. Light bulb for the chlorination room was burnt out and must be replaced. e. Rotometer for measuring chlorine feed rate was broken and must be repaired or replaced. 5. In accordance with Rule 62-555.350(1),F.A.C., the following are required for proper operating condition and protection from contamination of the aerator: aerator screens were coated with algae and must be cleaned. The issues of the auxiliary power with automatic start-up capability and auxiliary power plan will be handled as per the Department's letter dated April 26, 1994, (copy enclosed), in response to the City of Sebastian's letter dated April 8, 1994. [Auxiliary Power - Rule 62-555.320(6), F.A.C.] [Second Well - Rule 62-555.315(1), F.A.C.] 7. Please provide a copy of your cross -connection control program to this office with the date the copy was sent to the residents. [Rule 62-555.360(2), F.A.C.] To bring the subjectf system into complete compliance with relevant Department rules, please correct the indicated deficiencies and provide a written statement to the Department no later than November 7, 1994stating that all indicated deficiencies have been corrected. Please provide information, where readily available, for items marked on the sanitary survey report as "unknown". Reference materials on applicable drinking water regulations as well as cross -connection control are available upon telephone request to Ms. Trudy Wilkes at (407) 894-7555, extension 3318. This acceptance is qualified as follows: By October 31, 1994 either one of the two options should have been implemented. The interconnection with Sebastian Highlands water system is already activated, the Sebastian Highlands System is proven to have Sufficient available capacity to meet the demand created by adding the Park Place load and the auxiliary power Source at Sebastian Highlands is capable of running sufficient equipment to provide for half of the maximum day combined demand. The other option is to keep the Park Place system operational and install a stationary auxiliary power generator with an automatic startup capability. In the interim, we accept the portable generator proposal you submitted with an emphasis on minimizing the inconvenience and health risks that may occur during a power failure. If the initial monitoring for contaminants listed in Rule 1 7-550.310(2)(b), F.A.C., has been completed by December 31, 1992, and the system did not detect any contaminants, then one sample shall be taken annually beginning January 1, 1993. Do not send samples to the Department. If the Department determines that the system must take samples for UOCs, it will notify the owner. The samples will be taken at the system's expense. Reference Rule 17-550.410, F.A.C. NOTE 11 See Rule 17-550.511(4), F.A.C. - A system without asbestos -containing components, and which has no free asbestos in its source water, shall certify to the Department in writing that it is asbestos free. Certification shall satisfy subsections (1), (2), and (3) of this rule, and shall be submitted each nine-year compliance cycle during the specified year the system is required to monitor. No. 245653 Dear Mr. McNamara: I received your Notice of Denial of Use of General Permit dated March 21, 1994 in reference to the above development. The developer, Mr. Nelson Hyatt, will be submitting a new individual permit application in which Items 4 through 9 of the March 21, 1994 Notice of Denial will be addressed. The purpose of my letter is to respond to the first three items listed as reasons for denial as follows: Item 1 - Auxiliary Power The existing Park Place 0.1 mgd water treatment plant does not have a stationery emergency generator. This fact was addressed in my correspondence with the FDER in May and June of 1993. At that time, the Park Place system had fewer than 350 residents that it served. Since then, I have contacted Scott Telford of Aggreko, Inc. who gave me information on renting a 100 kw trailer mounted generator that Aggreko would transport the generator to the plant during emergencies when there would be no electrical power to the plant for a sustained period of time. The City of Sebastian was able to purchase the former GDU Sebastian Highlands Water System on December 17, 1993. As of January 26, 1994, the City Council authorized the consulting firm of Hartman & Associates to begin work on the interconnection of the Park Place system with the Sebastian Highlands system. Design of the project is expected to be completed by April 15, 1994. Construction of the project is expected to be completed approximately three (3) months after a permit is granted. The Sebastian Highlands water plant has a stationery 350 kw generator. Our certified operator is also responsible for the operation of the Park Place water treatment plant. The City has a plant operator at the Sebastian Highlands plant for seven days a week. An operator is on call 24 hours per day. In view of the fact that the City plans to decommission the Park Place water treatment plant, the City does not want to purchase and install a stationary generator. Therefore, based on the premise that the City can rent a generator in times of emergency, the City requests that the Park Place Mobile Home Park be allowed to expand its water system as proposed. Item 2 - Permit Application - Statement By Utility I am uncertain as to the statement made in the Notice of Denial regarding Item III Statement by Utility. The existing plant is a 100,000 gallons (0.100 mgd) per day water treatment plant as verified by the information received from Indian River County, the developer, and the EDER. The 30,500 gallon per day flow (0.0305 mgd) was taken from the December 1993 report (copy enclosed). The number of ERC's served and presently approved was based on the attached calculation sheets. I assumed that all of the 136 lots were already approved for service in Palm Lake Club since all of the water mains and services have been installed. To the best of my knowledge. I determined that 171 lots had been approved for service in Phase I of Park Place and 55 lots in Phase II during the initial permitting in 1986. Using 1.6 people per home (or meter) and 3.50 people per ERC (equivalent residential connection), I calculated the number of ERC's. If you disagree with the methodology, please let me know why and I will be more than happy to work with you in determining the figures you desire. Being that I did not obtain much information from Indian River County when the system was transferred, I do not have much history as the number of ERU's that were approved. Item 3 - Phase II Water Mains - Clearance for Service In regard to the EDER not having any evidence that the water mains in Phase II were cleared for service, I have attached a copy of your letter of March 14, 1990 to John Lang of Indian River County Utilities. The letter acknowledges receipt of certification by the County Utilities that the water distribution system has been completed in accordance with the plans for 37 lots in Phase II and Page 3 of 3 . �.., April 8, 1994 Letter to Joseph McNamar`*W ° in accordance with FDEP Permit WC3112040. These lots.weriff. approved for service by the Department. However, Phase II actually contains 55 lots, as you can readily see on the plans. Currently, there are 38 homes located on West Lakeview Drive in Phase 2 which are connected to the system. Also.. Lots 2300, and 2302 to 2308 (a total of 8) on Kelly Drive had water services installed from the property line to the 8" water main which was installed in the mid 1980's along with the other mains and services in Phase II. Please refer to the April 6, 1994 letter'prom Ernesto Velasco, PE of the Velcon Group, Inc. to me. It is ,apparent that Mr. Lang overlooked the fact that there were an additional eight lots on Kelly Drive which should have been cleared 14, 1990. The attached plan for service at the time he wrote his letter of March prepared by the Velcon Group of Port St. Lucie shows'the extent of the existing mains and services. Since the County Utilities Department may have shut off the water in the Kelly Drive water main, I had the developer authorize his contractor to flush the line, rechlorinate it, and take two consecutive daily bacteriological tests for main line clearance. The two samples were found to be satisfactory by Bio Services of Vero, Inc. and the bacteriological reports are included herein. At this time, I would ask for clearance on this main in Phase II for Lots 2300 and 2308 which are currently served by the existing main and water services on Kelly.Drive. Florida Administrative Code Rule 17-22.111 requires that water treatment plant operation reports be submitted to the department or designated county health depart- ment on a monthly basis. Forms supplied by this department are to be used for tabula- tion of the operational data and must be signed by the certified water plant lead operator prior to submittal. 4. Report any abnormal occurrences immediately as required by Florida Administrative Code Rule 17-22.107. Changes in applicable laws and regulations which affect operating procedures and/or quality standards must be complied with. In addition, we wish to call your attention to the re- quirement that no sanitary hazards, regardless of how slight, shall be placed within 100 Eeet of a public water supply well and under certain circumstances, this distance can be increased. The terms, conditions, requirements, limitations, and restrictions Bet forth herein are "Permit Conditions" and as such are binding upon the permittee and enforceable pursuant to the authority of Sections 403,161, 403.727, o: 403.859 through 403.861, Florida Statutes. This permit does not relieve the permittee from liability for harm or injury to human health or welfare, animal, plant or aquatic life or property and penalties therefor caused by the construction or operation of this permitted source, nor does it allow the permittee to cause pollution in contravention of Florida Statutes and department rules, unless specifically authorized by an order from the department. 6. The permittee shall at all times properly operate and maintain the facility and systems of treatment and control (and related appurtenances) that are installed or used by the permittee to achieve compliance with the conditions of this permit, as required by department rules. This provision includes the operation of backup or auxiliary facilities or similar systems when necessary to achieve compliance with the conditions of the permit and when re- quired by department rules. 7. The permittee, by accepting this permit, specifically agrees to allow authorized department personnel, upon pre- sentation of credentials or other documents as may be required by law, access to the premises, at reasonable time, where the permitted activity is located or conducted for the purpose of: a. Having access to and copying any records that must be kept under the conditions of the permit; b. Inspecting the facility, equipment, practices, or operations regulated or required under this permit; and c. Sampling or monitoring any substances or parameters at any location reasonably necessary to assure compliance with this permit or department rules. - Reasonable time may depend on the nature of the concern being investigated. 8. In accepting this permit, the permittee understands and agrees that all records, notes, monitoring date and other information relating to the construction or operation of'this permitted source, which are submitted to the depart- ment, may be used by the department as evidence in any enforcement case arising under the Florida Statutes or department rules, except where such use is proscribed by Sections 403.73 and 403.111, Florida Statutes. 10. Distribution system sampling locations shall be specified on "As Built" plans submitted by the project engineer. 3. Where water and sewer mains cross with less than 18" vertical clearance, the sewer will be 20' of either ductile iron pipe or concrete encased vitrified clay or PVC pipe, centered on the point of crossing. When a water main parallels a sewer main a separation, measured edge to edge, of at least 10' should be maintained where practical. This permit does not pertain to any wastewater, stormwater or dredge and fill aspects of this project. 5. Total number of active services shall be limited to 175 pending installations and departmental clearance of the standby well and auxiliary power with automatic startup capability in accordance with Rule 17-22, Section 106, F.A.C. 6. The future standby well must also be located a minimum 100' from sanitary hazards including wastewater lines and other separation requirements. 7. IMPACT FEES: After five years from the date of this agreement SELLER shall be obligated to pay Impact fees to the COUNTY, at the rate then current, for each unit which thereafter requires a Certificate of Occupancy. Units which have had a Certificate of Occupancy Issued to them before five years from the date of this agreement must have an Impact fee paid when that unit is resold, without regard to the five-year SELLER's grace period. At closings on such sales, SELLER or successor in title shall collect the Impact fee and remit It to COUNTY. 7. SURCHARGE ON RATES: CuuiarY shall estabIIsh a surcharge on water and wastewater rates for customers in the service area as shown on Exhibit "D." From the time I have received your letter, I have been trying to obtain information on the clearance of the "second well" as referenced in your second paragraph. I have talked with Glenn Schuessler of the Indian River County Environmental Health Dept.; Harry Asher, Bill McCain, and Brad O'Keefe of the Indian River County Utilities Dept.; Bill Frink of East Coast Laboratories; and Nelson Hyatt, former owner of the Park Place water treatment plant. At present, I have only been able to find the twenty (20) consecutive bacteriological tests for the first well on the west side. This well is a 3" diameter well inside a 6" diameter casing. It was drilled on January 6, 1986. The second well or east well is a 2" diameter well inside a 4" casing. It was drilled on March 22, 1985 according to the Well Completion Report. Copies of both well completion reports are attached. Therefore, in accordance with the dates on the well completion reports, the second well was actually drilled first and has been supplying water to the Park Place development (formerly known as The Villages of Lake Delores) for the past eight years! In searching for information about the wells, I also received the Drinking Water Bacteriological Analysis reports from March 8, 1990 through December 9, 1992. With the exception the September 25, 1991, report showing the total coliform bacteria to be 20 for Well No. 1 and the June 13, 1990, report for Well No. 2 showing the total coliform bacteria to be "To Numerous To Count" (TNTC), all of the remaining tests reveal no bacteriological contamination of the wells. I would surmise to say that inaccurate sampling was the cause for the unsatisfactory tests, not bacteriological contamination of the wells themselves. Water Facilities Administrator From June 13, 1990 to December 9, 1993, Well No. 2 has had 30 consecutive months without any coliform bacteria counts in its water samples. Therefore, I would think that in all practicality, the well had to be disinfected shortly after it was drilled in 19e6. I would sincerely hope that your Department will take this fact into consideration. In regard to the main clearance of the "second well", I have questions of you as follows: 1) Why did the Florida Department of Environmental Regulation wait for almost eight (8) years to realize that the well wasn't cleared? 2) Why, after these many years and with all of the satisfac- tory historical bacteriological data submitted to your office, would you now require the operating authority to to take the well out of service for disinfection and testing since tests do not show bacteriological contamina- tion? I know rules are rules and certainly they should be adhered to as a matter of policy in most situations. However, under unusual circumstances, such as the one surrounding Well No. 2, I believe governmental entities need to employ common sense and flexibility on a case by case basis for granting waivers or exceptions to the rule. Therefore, based on 30 consecutive months of absolutely no bacteriological contamination in Well No. 2, I would request that your Department grant main clearance to it. I don't believe that the Department of Environmental Regulation should penalize the County or the City of Sebastian for something the DER overlooked eight years ago when the project developer initially drilled the well. Main clearance should have been required of the developer years ago. Let me address the matter concerning an auxiliary power source with automatic start up capability for emergency operation of the Park Place Water Treatment Plant. This request was originally made by your Department on July 27, 1992, as I have learned from Harry Asher, Assistant Indian River County Utilities Director. Unfortunately, I was not furnished with copies of the Department letters dated July 27, 1992, and January 4, 1993, and summarily do not have the knowledge of their contents. However, I was informed by Harry that your Department would not accept the use of the County's portable generator in times of emergencies. Your Department mandates that a stationary generator be constructed at the Plant. Page Three of Four May 3, 1993 Mr. Carlos Rivero-de Aguilar, P.E. Water Facilities Administrator One of the goals and objectives of the City of Sebastian is to connect the Park Place water treatment system to the General Development Utilities (GDU) system as soon as possible. The City has entered into negotiations with GDU and has made an offer to purchase the existing GDU water treatment plant and system. If accepted by GDU, the City expects to takeover the system on or after July 15, 1993. Once the offer is accepted, the City will direct its engineering consultant, Hartman & Associates, Inc. to prepare the design plans and let for bids the construction of a 10" water main extension to connect both the Park Place and GDU water systems. As soon as the connection is made, the existing Park Place Water Plant and wells will be abandoned. The GDU plant will supply the water necessary for Park Place and already has an existing emergency generator. As a interim alternative measure before abandonment of the Park Place Water Plant, I have discussed with Harry Asher, Asst. I.R. Co. Utilities Director, the possibility of having Indian River County's Pelican Pointe Water Plant supplying Park Place and Palm Lake Club with water in times of emergency. There exists a normally closed gate valve in a common water main connecting both systems. Also, during periods of electrical outage, the water plant at Pelican Pointe will be operated by a generator installed by Indian River County Utilities Department. Mr. Asher told me the County could supply the Park Place system with water in times of emergencies. In talking with the operator, Scott Bond, he recalled only one incident when the electrical power at the plant went out since 1989, the year the County started operating the facility. Lastly, in accordance with the Florida Administrative Code Rule 17-555.320 (6), auxiliary power is required for all community ststems that serve 350 or more persons. As of today, if all of the homes were occupied, the total residential population in Park Place would be 314 persons and 17 persons in Palm Lake Club.
