A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, REPEALING RESOLUTION NO 08-27, RELATING
TO MUNICIPAL CEMETERY RATES; ESTABLISHING NEW
CEMETERY RATES FOR IN -GROUND LOTS, CREMAINS LOTS,
COLUMBARIUM NICHES, PERSONNEL SERVICES, CORNER
MARKERS, AND NICHE VASES AND RINGS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR
SCRIVENER'S ERROR; AND PROVIDING FOR EFFECTIVE DATE.
WHEREAS, City of Sebastian, Indian River County, Florida owns and operates a
municipal cemetery; and
WHEREAS, on December 10, 2008 the City Council of the City of Sebastian,
Florida, previously established in Resolution No 08-27, the Sebastian Municipal
Cemetery Rates; and
WHEREAS, the City Council has determined it necessary to revise and update
the cemetery rates and repeal cemetery rates established in Resolution No 08-27; and
WHEREAS, it is the intent of the City Council to repeal the Sebastian Municipal
Cemetery Rates as adopted and established by Resolution No 08-27, ensuring that the
public are provided with updated prices for specific properties, service preparation and
other administrative services that are included; and
WHEREAS, Section 34-11 of the Code of Ordinances of the City of Sebastian require
that cemetery rates be set by resolution; and
WHEREAS, following a review of existing rates, it was determined that the fees for
services needed adjustment to be more in line with actual city personnel costs and less
confusing to the purchaser.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, THAT:
Section 1. INTERMENT AND SERVICE RATES. Interment and service rates are
hereby established as follows:

4' x 5' Cremains Lots (1 cremains) $1,500.
Columbarium Niches— Single (includes plaque)

Columbarium Niches — Double (includes plaque) $4,800.
URN SIZE — 12 !/e " wide. 7" high. 9" deen.

Interment Rates
Surveying and marking the site for the excavator and monument company. Removal of
Flowers after the service. Excavation for in ground cremains. Preparation of niche before
and after the service.

Section 2. SERVICES INCLUDED AND EXCLUDED. The purchase price for in -
ground interment sites includes insect extermination, sodding, traffic direction for the service,
and perpetual care of the site. The purchase price for niche interment space includes a bronze
plaque, engraved, and mounted by the City of Sebastian. However, price does not include the
cost of installing a suitable concrete foundation for grave markers as required by Section 34-18
of the Code of Ordinances of the City of Sebastian or the marker itself. Further, in the event of
theft or damage of any site or niche, survivors of the interred are responsible for all replacement
costs.
Section 3. CONFLICT. All resolutions or parts of Resolutions in conflict herewith are
hereby repealed.
Section 4. SEVERABILITY. The provisions of this Resolution are intended to be
severable. If any provision of this Resolution is determined to be void or is declared illegal,
invalid, or unconstitutional by a Court of competent jurisdiction, the remainder of this Resolution
shall remain in full force and effect.
Section 5. SCRIVENER'S ERROR. Sections of this ordinance may be renumbered or
re -lettered and corrections of typographical errors which do not affect the intent may be
authorized by the City Manager, or the City Manager's designee, without need of public hearing,
by filing a corrected or re -codified copy of same with the City Clerk.
Section 6. EFFECTIVE DATE. This resolution shall become effective immediately
upon adoption.
This resolution was moved for adoption by Council Member McPartlan . The motion
was seconded by Council Member Dodd and, upon being put to a vote, the vote was as
follows:

The Mayor thereupon declared this Resolution duly passed and adopted this 13th day
