HomeMy WebLinkAbout2024 - LeaseccCC �OF E HOME OF PELICAN ISLAND SEBASTIAN MUNICIPAL AIRPORT 1225 Main St. Sebastian, FL 32959 HOUSING AGREEMENT This agreement is voluntarily entered into between the City of Sebastian and Jennifer McElvy, City of Sebastian Police Officer. BACKGROUND: It is the intent of the City of Sebastian, and the Sebastian Municipal Airport, to have Sebastian Police support at the municipal airport on short notice, and on site, for patroUenforcement duties. To that end, the Sebastian Municipal Airport has offered to provide housing to a qualified Police Officer in exchange for 24/7 security/policing duties at the airport. The following list is not meant to be an exhaustive list of necessary conditions, covenants and requirements, but as City/Airport expectations if a Law Enforcement Officer residing in the Airport Security quarters. DESCRIPTION/CONDITIONS: 1. The term of the underlying agreement shall be for a two-year period. The Law Enforcement Officer residing in the security quarters shall be known as the Airport Security Officer, or Security Officer. 2. This agreement may be cancelled/terminated by either party of any reason, or no reason, given 30 days written notice. 3. The Security Officer must provide for fire and liability insurance covering the Security Officer's personal property within the security quarters. 4. The address shall be: the designated parcel on Sebastian Municipal Airport. The Security Officer is the resident of record The Security Officer may choose to have only his/her immediate family to also reside at the security quarters. If, for rg<yt reason, the Security Officer may become single, and/or separated from their spouse, the Security Officer is the only authorized resident of the security quarters. 5. Utility services must be transferred to the Security Officer within one (1) week of occupancy. The Security Officer shall be financially responsible for any/all utility charges to the security quarters. 6. A verifiable inventory list of City -owned contents must be submitted within one (1) week of occupancy to the Airport Manager. 7. The Security Officer shall be responsible for all care and maintenance of the security quarters, interior and exterior. Airport maintenance will provide grass mowing only. g. Upon reasonable notice, the Security Officer shall provide access to the security quarters for inspection by City officials, and/or State and Federal officials. 9. In the event of the Security Officer's death, the City of Sebastian shall provide the remaining spouse and/or children to remain in the security quarters for a period of ninety (90) days, rent free. 10. The Security Officer, or any resident, shall not cause by any act, or omission, any liens, encumbrances, or judgements to be placed, assessed, or established on the security quarters, or upon the property upon which said residence is situated. 11. The Security Officer shall not, without first attaining the written consent of the Landlord, make any alterations, additions, or improvements to, or about, the premises. 12. This agreement may be cancelled/terminated for cause at any time by Landlord. If, at any time, the Security Officer is charged with immorality, job misconduct, gross insubordination, willful neglect of duty, drunkenness, lewd and/or lascivious acts, illegal drug use, or release as an employee of the City of Sebastian, such matter shall cause this agreement to terminate. As a result, the Security Officer, and all family members, shall vacate the property within 72 hours, at their own expense, and remove all belongings without regard to any procedures, or rights, provided in Chapters 83 and 513 of Florida Statutes. ESSENTIAL FUNCTIONS: 1. The Security Officer shall be responsible for regular, periodic patrol and law enforcement duties at the airport. The Security Officer shall become familiar with the Rules & Regulations, and Minimum Standards as contained in the Principal Guiding Documents for Sebastian Municipal Airport. Examples of regular duties include: a. Ensure safe aviation operations by preventing persons or vehicles from being on active aircraft movement areas. b. Enforce vehicle activity as to having permission to be within the airport perimeter and operated at safe speeds in appropriate areas. c. Familiarity with Aircraft Accident response procedures, communications and follow-up. 2. The Security Officer shall be the Law Enforcement liaison between the City of Sebastian, Airport Administration, Airport Tenants, Tenant employees, Guests, and Transient Visitors. It is understood that the Security Officer will establish their presence as a friendly and protective force in support of Airport Tenants and their businesses or property. To the greatest extent possible, it is expected that the Security Officer is actively visible and accessible to Tenants. Efforts should be made to understand the operation of the airport along with the activities that commonly take place. 3. It is expected that, if necessary, the Security Officer shall utilize their arrest authority to help secure the Airport and prevent unlawful activity. 4. The Security Officer shall be prepared to perform other Law Enforcement duties as directed by the Sebastian City Manager, Sebastian Chief of Police, or the Airport Manager. 5. The Security Officer shall use the security quarters for the purpose and in support of, aviation services at the Sebastian Municipal Airport. In no case shall the Security Officer, or a resident of the security quarters, utilize the residence in support of an additional business.On the first of each month, the Security Officer shall provide to the Airport Manager a detailed "daily security log" for the previous month addressing any airport security issues and patrol times. 6. The Security Officer shall establish, and maintain, procedures for notification of the Sebastian Police Department and the Airport Manager in case of any suspected trespass, vandalism, or any perceived crime. 7. The Security Officer will be responsible for the verification of individual Airport ID badges and permitted Vehicle Sticker registrations, and assist in the maintenance of those records. a. The Officer will be provided with regular, updated lists of current and expired badge holders. b. The Officer will administer the Vehicle Stickers that allow for on -airport access/permission, by verifying Driver's License, Registration and Insurance, issuing recorded stickers and distributing Airport Vehicle Guidelines to each recipient. S. The Security Officer shall be the "after-hours" contact with Airport tenants, visitors and transient traffic. This can encompass granting airport access, watching for odd activity or unauthorized trespass, and addressing basic requests for assistance as capable.
