HomeMy WebLinkAbout2004 AmendmentASSIGNMENT AND AMENDMENT OF AIRPORT NON-AVIATION LEASE AGREEMENT THIS ASSIGNMENT AND AMENDMENT of that certain AIRPORT NON-AVIA770N LEASE AGREEMENT by and between the CITY OF SEBASTIAN and Steven Philipson, dated January 3D, 2004, (hereinafter called the "Lease") provides as follows: WITNESSETH: WHEREAS, the Landlord is the owner of certain property located in the County of Indian Fiver, Florida; and WF~REAS, the Landlord agreed to lease such property to the Tenant under a-Lease dated 7anuary 30, 2004; and WHEREAS, Tenant wishes to assign said Lease to a related entity and. add to the area governed thereby; and WHEREAS, Landlord is agreeable to said changes; NOW, THEREFORE, in consideration of the mutual covenants hereinafter provided, the receipt and sufficiency of which are hereby acknowledged, the parties have agreed as follows: 1. Landlord hereby consents to assignment of the Lease to Sebastian Airport Storage, LLC. 2. Tenant re ins personally obligated under the terms of said Lease and, by their signatures below, Sandra . u~M d Lois Philipson join as additional personal guarantors of the Tenant obligations thereunder. 3. The area of lan ]eased to said Tenants is hereby amended to include all the land located within the boundaries of Roseland Road and the loop of Central Airport Drive and Airport Drive West as shown by the attached sketch and legal description, and rent thereupon shall be calculated based upon the total square footage of said amended parcel. In accordance with directives issued by the City Council at their July 27, 2005 meeting, this memo shall serve as final notice that all procedures have been fulfilled. Further, this memo shall be made part of the official site plan and kept on record in your office.
