HomeMy WebLinkAboutLaw Enforc - Sexual PredatorsAGREEMENT BETWEEN INDIAN RIVER COUNTY SHERIFF CITY OF VERO BEACH POLICE DEPARTMENT CITY OF FELLSMERE POLICE DEPARTMENT CITY OF SEBASTIAN POLICE DEPARTMENT INDIAN RIVER, SHORES DEPARTMENT OF PUBLIC SAFETY THIS AGREEMENT, entered between the Fellsmere Police Department, Indian River Shores Department of Public Safety, Veto Beach Police Department, Sebastian Police Department and the Indian River County Sheriff's Office, hereafter called the Law Enforcement Community is established: As a sole unit, the Law Enforcement Community recognizes that the safety and education of the public is better served when approached from a unified front. All agencies hereby agree to share information, resources and experiences where Sexual PredatodOffender notification and tracking are concerned. As a means to this end: The Chief Law Enforcement Official of each individual agency agrees to establish a COMMUNITY NOTIFICATION COMMITTEE represented by a member of each Law Enforcement Agency to conduct investigations and aid in the notification of the civilian population within Indian River County. The Community Notification Committee members agree to meet on a regular basis to share information involving sexual predators/offenders residing and/or working in the Community. The minimum notification protocols will be implemented no later than two (2) business days after notification of a sexual predator moving into Indian River County. The Community Notification Committee will make recommendations to the Chief Law Enforcement Officials on the public and private agencies outside the law enforcement community to be directly involved in the notification or investigative process. The cost of community notifications shall be the responsibility of the Agency where the sexual predator/offender is residing. In the event an Agency does not have funds to pay for the notification, a request for assistance may be made to the Notification Committee. SEXUAL PREDATOR/OFFENDER NOTIFICATION: - Upon notification that a Sexual Predator has moved into Indian River County, the Indian River Sheriff's Office will FAX a copy of the registration form, including the photograph to all law enforcement agencies in the county. II. The Indian River County Sheriff's Office will make direct contact with the agency having jurisdiction of the predator's residence. The Indian River County Sheriff's Office based on the registration information will initiate an offense report. This report will be delivered to the Law Enforcement Agency conducting the investigation, along with an original, color photograph of the predator. An investigative checklist, agreed upon by the committee, will be used as a guideline to ensure the investigations are standardized throughout the community. II1. The jurisdictional agency, after conducting an investigation into the predator's background, including interviews with the predator, accessing the neighborhood where the predator lives and works, may notify the Community Notification Committee for the purpose of reporting the results of the investigation and to distribute additional information when necessary. It is strongly suggested to convene if exigent circumstances exist. The committee will make a recommendation to the Chief and the Shedff of the agencies involved as to the best-recommended method, frequency and time frame of community notification. At a minimum, all notifications involving Sexual Predators may include: Placement of a display advertisement in the local newspaper, along with a standard press release. The investigating agency shall prepare and distribute both documents to the local media. Within a two-block radius of the residence of the predator, handbills will be distributed to each home or business. These flyers may be mailed, or hand delivered by law enforcement personnel. All Law Enforcement Agencies within Indian River County agree to distribute the informational flyer including the predators photograph to all schools, both public and private and to all licensed day care centers within their jurisdictions. 4. Notification on Offenders will be made at the discretion of the Law Enforcement Agency in the residence jurisdiction. Additional methods of notification may include, but are not limited to: Display of posters in common areas such as the public library, local grocery stores, shopping areas, video stores, movie theaters. IV. Distribution of flyers through bulk mailings to all residents within the county. Special notifications to local youth group agencies, such as Boy and Girl Scouts, area youth guidance groups, etc. 4. Community Meetings In neighborhoods where the residents may not be static, such as apartment complexes, campgrounds, etc., the need to re-implement the above steps will need to be reviewed by the Community Notification Committee. Community Meetings: As an additional measure and to further involve the civilian community in our efforts, a series of Community Meetings may be held. It will be the purpose of these meetings to educate the general public on what they can expect from Law Enforcement, and more importantly, what the public can do to protect themselves and assist law enforcement. Community meetings may be held in familiar locations, such. as Sebastian High School, Vero Beach High School and Oslo Middle School. A Crime Prevention forum to address the changes in the laws with regard to sexual predator/offender notification may be used. The Chief Law Enforcement officer of each agency should be prepared to attend each meeting. D. An outline for the meeting should include: Explanation of the Public Safety Information Act. The types of notification the community can expect. Additional methods of notification that may be used if the situation warrants. What the "neighbors" responsibilitie~ are to the "predator". Ideas on what the neighborhood can do in ALL circumstances to help, protect themselves. Reporting suspicious incidents, getting to know their neighbors, etc. A list of contacts within each law enforcement agency. This Agreement constitutes a final written expression of all the terms of this Agreement and is a complete and exclusive statement of those terms. IN WITNESS, of the parties have caused this Agreement to be signed by their duly authorized officers.
