HomeMy WebLinkAboutSex Offender Registry & DatabasMEMORANDUIVI OF U1NDERSTA.NDING · This Memorandum of Understanding ~s entered into by and between the Florida Depamnent of Law Enforcemem and the undersigned law enforcement agencies, in furtherance 'o£their respective duties ,,nder law. WHEREAS, the Florida Legislature passed amendments to Sections 775.21 and 943.0435, Florida Statutes, during the 2000 Session; and WHEREAS, these amendments require county mad local law enforcement agencies, in conjunction with the Florida Depat aa~ent of Law ~;.nforeement, to verify the addresses of sexual predators and sextufl offenders who ~re not under the care, enstody, control, or supervision of the Department ofCorreetinns; sncl WHEREAS, the Florida Deparmaent of Law ~.nforcement bas continued to m.~-,.~n the Sex Offender Keg~u'g and DatabaSe, to conduct quarterly m~l~nEs to ascertain current address information regartt~nE registered sexual offenders and se~m] predators and to ms,ninOn all relevant data readily aecess~le to law en.foreement ageaeies statewide; and WHEREAS, local law enforcement agencies are best suited to perform the ~mportaat responS~ility of direct address verification ofragistered sexual offenders ~n~ sexual predators in conj-netinn with their ro,~ patrol and comr~-~typo]ieing efforts, NOW THEREFORE, the parties agree as follows: ¸1. The' Florida Deparmaent of Law r;.nforeement (FDLE) will continue to z-~nts~n the Sex Offencter Registry and Database ~nr] continue to nna~ veaqfication letters to those registered sexual offenders ~nd sextlal predators requh4.ng ,arlress verification, with sexual predators be,~ng forwarded letters 'quarterly ~ sex'ual offenders being forwarded lett~s ~=r~,a~y. FDLE will continue to ~rack responses snd lack of responses to these ma{l~ngs to ' regist~zl sexual offenders and sexual predators. FDLE will oonHm~ to msk¢ infor~tlon regarding registered offenders and predators who ~! to respond to such letters available to local agencies. FDLE will continue to do so in a timely ~a~wner. 3. FDLE will continue to rns~nm~n; update and offer on-line access ~o the Sex Offender Database and Adtlress VerLfieation System. 4. The undersigned law enforcement agencies will develop specific policies reg~ra~ng the verification of addresses of released sexual offenders ,vd sextufl predators. Tbe undersigned law enforcement agencies will promptly.conduct on-site residential . address verifications of sexual predators and sexual offenders 'not under the supervision of the Depam'uent of Corre~ons when such persons fail to respond to an FDLE verification letter. At ml.ln~m~; the undersigned law enforcement agencies will conduct such address verifications, as to those who have failed to respond to an FDLE verification iet~e~, quarterly for semml predators and ~.~lly for sexual offenders. 6, The undersigned law enforcement agencies will ~ssare that' personnel assigned to pcafonn these t~ks receive appropriate tr~i~g and access to thc on-line FDLE Sexual Offender Database and Address Verification System 7.
