HomeMy WebLinkAboutIRC Taft Street Paving Project INTERLOCAL AGREEMENT BETWEEN INDIAN RIVER COUNTY, FLORIDA (COUNTY) CITY OF SEBASTIAN, FLORIDA (CITY) FOR A SHARED COST FOR A PORTION OF THE TAFT STREET PAVING PROJECT THIS 1NTERLOCALAGREEMENT, entered into this ist Dayof February __, 2000, by and between Indian River County, Florida, a Political Subdivision of the State of Florida, by and through its Board of County Commissioners, hereinafter referred to as COUNTY and the City of Sebastian by its Manager with approval of City Council, hereinal2er referred to as CITY, for the purpose of providing for the costs of construction within the Taft Street right-of-way in the City, by the City, to the County, which will perform the construction. WITNES ETH: WHEREAS, the County mad the City both have paving projects to be performed in close proximity to each other, and; WHEREAS, the City provided survey information to the County for design purposes, and; WHEREAS, the County has designed the projects to be consta acted, and; WHEREAS, the County has obtained a St. John's River Water Management District Permit, and; WHEREAS, the County Road & Bridge Division will construct all improvements shown on the construction plans, and; Page 1 WHEREAS, the City will reimburse the County the cost of work performed within the Taft Street right-of-way. NOW, THEREFORE, in consideration of the mutual terms, conditions, promises, covenants and premises hereinafter set forth and pursuant to the authority of Section 163.01 Florida Statutes, the City and the County agrees as follows: A. The foregoing recitals are hereby incorporated and made a part hereof. B. The City will reimburse the County for all construction costs (including material and labor) for improvements constructed in the Taft Street right-of-way. Cost shall not exceed $18,000.00. C. This Agreement shall take effect upon ratification of both the City and the County, and shall terufinate on July 31, 2000. D. This agreement shall be executed in duplicate mad each fully executed contract shall be deemed as original instrument. E. A copy of this agreement and all subsequent amendments hereto shall be recorded in the Public Records of Indian River County, Florida, upon its execution and approval by all parties to this agreement. F. At the completion of construction, the County will invoice the City upon which the invoice shall be paid in accord with the "Florida Prompt Paymeut Act," pursuant to the authority of Section 218.70 Florida Statutes. G. Should this agreement be t~rminated by either party prior to completion, the City agrees to pay for that portion of work that has been completed.
