HomeMy WebLinkAboutIRC Schumann Dr Drainage Proj [NTERLOCAL AGREEMENT between INDIAN RIVER COUNTY, FLORIDA and CITY OF SEBASTIAN, FLORIDA This Interlocal Agreement, entered into this//-//~ day~-///.~/ , 1999, by and between INDIAN RIVER COUNTY, FLORIDA, a political subdivision of the state of Florida, hereinafter referred to as COUNTY, and the CITY OF SEBASTIAN, FLORIDA, a municipal corporation of the State of Florida, hereinafter referred to as CITY, for ne purpose of utility relocations, provides: WITNESSETH: WHEREAS, the COUNTY and CITY agree that utilities owned by the COUNTY are located in the CITY Right of Way along Schumann Drive; and WHEREAS, the COUNTY accepts responsibility to relocate these facilities when in conflict with CITY facilities; and WHEREAS, the CITY intends to install storm drain facilities that require relocation of the utilities owned by the COUNTY; and WHEREAS, the COUNTY can benefit from having the CITY contractor relocate said facilities during storm drain construction; and WHEREAS, an undertaking of this nature is in keeping with the "Florida Interlocal Cooperation Act of 1969" as set forth in Florida Statutes Chapter 163; NOW, THEREFORE, in consideration of the mutual terms, conditions, promises, covenants and premises hereinafter set forth and pursuant to the statutory authority contained in F. S. Chapter 163, the COUNTY and CITY agree as follows: The COUNTY authorizes the CITY construction contractor to relocate COUNTY water and wastewater utilities along Schumann Drive that conflict with new storm drain pipes to an acceptable location, and CITY agrees to include said work in its contract for the Schumann Drive Project. 2. Within forty five (45) days of invoice by CITY, the COUNTY agrees to reimburse the CITY contractor's bid price of $82,250 for said utility relocation on the basis of work completed, accepted by the County and paid for, plus any additional costs approved by the COUNTY as necessary and legitimate changes, or for which the CITY is ultimately found liable due to the utility relocation portions of the contract, that may be arise. 3. The COUNTY agrees to provide technical oversight and construction inspection of the utility relocation aspects of the Project. IN WITNESS WHEREOF, the parties hereto have caused this interlocal agreement to be executed by their duly authorized officials on the day and year first written above.
