APPROVAL OF MINUTES - 12/13/06 Meeting A MOTION was made by Ms. Coy, and SECONDED by Mr. Neglia, to approve the December 13, 2007 CRA minutes with a voice vote of 4-0. 5. NEW BUSINESS A. Presentation of Annual Sebastian CRA Report for Forwarding to City Council (City Clerk Transmittal and Annual Report Prepared by Finance Director The City Manager submitted the report as required by Florida Statutes. A MOTION was made by Ms. Coy and SECONDED by Mr. Neglia to approve the annual report for submittal to the City Council with a roll call vote of 4-0. ~1 CRA Meeting February 28, 2007 Page Two 6. OLD BUSINESS A. Yacht Club Update/Budget Amendment (Gifu Manager Report The City Manager updated the CRA on the Yacht Club property improvements as set out in the agenda packet. Mr. Paternoster asked if there was any appropriation for finger docks, and the City Manager said there were not at this time, but it is staffs intention to pursue funding and complete the project. Mr. Neglia said he is happy that this project is going along well. Mayor Burkeen said this project should be completed before looking at the docks. He asked for a completion date. The City Manager said staff is shooting for April for completion. Damien Gilliams, U.S. 1, asked if funds were included for removal of derelict vessels. The City Manager answered the FEMA reimbursements insurance paid for some removal. Mr. Paternoster pointed out it was included in the $20,000 slated for the Fine Arts Festival and derelict boat removal. Mr. Gilliams said there were still derelict vessels in the river. Mr. Gilliams asked about insurance monies paying for some of the Yacht Club repairs to which the City Manager explained insurance monies put a new roof on the building. Mr. Gilliams asked about the parking on the south property abutting the Flagship restaurant to which the City Manager said it needed to be a staging area. Mr. Gilliams said a breakwater would be helpful on the main dock and asked for one underneath the dock. The Public Works Director advised dockowners do not recommend breakwaters because it adds stress to docks. Mr. Paternoster suggested that the feasibility/cost estimate/pros & cons be obtained from neighboring docks. The Clerk pointed out in the minutes of September 27, 2006 indicated marked funds for derelict vessels. The Mayor added that some of the unused gateway money might be available. A MOTION was made by Ms. Coy, with a SECOND by Mr. Paternoster, to approve the updated budget and amendment staff was directed to look into the breakwater for the next meeting with a roll call vote of 4-0. 7. EXPENDITURE REQUIRED: AMOUNT BUDGETED: APPROPRIATION REQUIRED: Unknown At This Time $801,242 $0 SUMMARY In January 2007, Jean Tarbell got the Consultant Competitive Negotiation Act (CCNA) process started by advertising for engineering firms to provide qualification informational packets. That information was received by the City on February 20, 2007, when a Selection Committee made up of Shai Francis, Dave Fisher, Rebecca Grohall, Rich Stringer and myself reviewed the engineering firms (Shai Francis was unable to continue in the process after the initial ranking due to vacation and the Committee collectively voted that replacing her position was not necessary and did not violate any section of the CCNA). Jean Tarbell contacted each of you (prior to the elections) and made the RFQ packets available for your review. The CCNA process is outlined in Section 287.055 of Florida Statutes. The CCNA requires that professional services such as legal, architectural and engineering be ranked and hired according to qualifications; not price. Based on this process, the Selection Committee held two public hearings. The first was conducted on March 5, 2007 and the six firms that submitted material were preliminarily ranked. Those firms included: Schulke, Bittle & Stoddard; Neel-Schaffer; Keith and Schnars; Mastelller & Moler; Carter Associates; and, Moia, Bowles Villamizar and Associates. During the initial review, the Committee narrowed the field to three firms for formal interviews and those three firms were Schulke, Bittle & Stoddard; Neel-Schaffer; and, Keith and Schnars. The Committee based this determination on a consensus discussion and an individual appraisal/ranking of the six firms. These results quickly discovered that three firms separated themselves from the rest of the field as most qualified. At this point, of the three firms chosen best, no firm was given any advantage and the firms were contacted for formal interviews. The minutes of the March 5'h Selection Committee meeting are enclosed for your review. On March 12, 2007, the Selection Committee held the formal interviews and rated the top three firms based on five advertised and predetermined weighted criteria. Those criteria were (1) ~~ ~.: ~_.r-~ General Engineering Experience w/Consideration Towards Engineering, Landscaping and Redevelopment (25 Points); (2) Qualifications of Individuals Assigned to Project (25 points); (3) Past Pertormance History w/ City of Sebastian (25 Points); (4) Size and Organizational Structure w/Ability to Quickly and Professionally Complete Project Design Time Line (15 Points); and, (5) Demonstrated Understanding of Conceptual Indian River Drive/Main Street Concept (10 Points). 400 total possible points were available to each firm (100 points from 4 committee members) and the firm with the highest points would be deemed "best qualified". The interviews were duly advertised and conducted in the Council Chambers to promote public participation and openness. All firms were considered very qualified. Schulke was deemed best qualified because of (1) their past experience with the City; (2) the type of specialized improvement work they pertorm; and, (3) their highest demonstrated understanding of the project concepts. Simply stated, Schulke, Bittle & Stoddard presented 'a local firm, with a vested interest in the project and a proven, positive professional track record with the City of Sebastian. To be in conformance with the CCNA process, on Wednesday, March 28, 2007, staff will be requesting that, based on the above mentioned criteria, the CRA designate Schulke, Bittle & Stoddard as the best qualified firm and authorize staff to begin contract negotiations. Once a price is determined, a proposed agreement will be returned to the CRA for approval and a notice to proceed. Should a fair market price not be realized, the CCNA process will repeat itself with the next best-qualified firm until a design contract is awarded. ~, i y. UPDATE ON PROJECT ISSUES MOVING FORWARD - We are very close to the estimated time line. However, the design phase will take longer than originally anticipated. During the interviews, each of the firms interviewed gave some indication that the time-line was "aggressive". At least two of the firms indicated that completing the design, as well as getting permitting would probably take closer to 9 months, rather than the estimated 6 months. To date, approximately $408,600 has been spent as follows: ITEM Purchase w/ Closing Costs Appraisals Preliminary Engineering Concepts (Neel-Schaffer) TOTAL $6,350 $7,250 $408,600 $392,612 remains allocated for the project in this fiscal year. This should be more than enough funding to cover the cost of engineering services for the duration of the project. PROPERTY TAX REFORM -The project's initial total cost estimate was $1,500,000. To date, I am not sure if this will be accurate. One portion of the engineering contract will be to compile a better project budget. Nonetheless, while the CRA fund is currently healthy and can support this expenditure via short-term debt, or possible cash, I am a little concerned -that the tax reform effort has the potential to negatively affect CRA funding. No tax reform proposal, currently being discussed in Tallahassee, has taken into consideration the effects of a "roll back" rate on CRA districts. Additional information on this topic will certainly need to be forthcoming to determine potential effects. While I do not think this concern warrants stopping the design of this project, I did want to note the concern for the record. It will be important to monitor this sweeping legislative reform movement. GRANT MONEY - We have received positive feedback that the Indian River Estuary Lagoon Program may provide $450,000 in funding over the next three years. As information becomes available, staff will update Council. ENGINEERING AGREEMENT SCOPE OF SERVICES - In summary, as we move forward to negotiate a professional service agreement the following are specific professional services that will be required and negotiated: 1. Design (w/ Public Participation) and Construction Administration/Management 2. Survey and Geotechnical Services 3. Environmental and Governmental Permitting 4. Project Budgeting and Detailed Cost Estimates 5. Other Services as May be Deemed Necessary for Project Design RECOMMENDED ACTION Designate Schulke, Bittle & Stoddard as most qualified and authorize staff to begin contract negotiations. Any such contract will require formal CRA action and consideration. ~~ MINUTES CONSULTANT SELECTION COMMITTEE MEETING MONDAY, MARCH 12, 2007 INTERVIEWS OF ENGINEERING FIRMS TO PROVIDE ENGINEERING AND PROFESSIONAL SERVICES FOR THE CITY OF SEBASTIAN INDIAN RIVER DIRVE/MAIN STREET IMPROVEMENT PROJECT The Sebastian Consultant Selection Committee convened at 9:05 a.m., on Monday, March 12, 2007 in the Sebastian City Council Chambers, located at 1225 Main Street Sebastian, Florida. Committee Members Present: Recording Secretary: Al Minner, Chairman David Fisher, Committee Member Rich Stringer, Committee Member Rebecca Grohall, Committee Member Jean M. Tarbell, Executive Assistant Chairman, Al Minner called the meeting to order at 9:05 a.m. Mr. Minner briefly explained that the Consultant Selection Committee will conduct interviews of each engineering firm as short listed at their March 5, 2007 Committee Meeting. Chairman Minner, reiterated that while each firm was numerically ranked at the previous meeting in order to select finalist for interviews, no firm had an advantage over the other going into the final interviews. The firms selected for interviews were: Shulke, Kittle and Stoddard, LLC Neel -Schaffer Keith & Schnars, P.A. Shulke, Kittle and Stoddard, LLC 717lndian River Drive, Suite 201 Vero Beach, FL 32960 At 9:10 A.M. Joe Shulke, P.E., Shulke, Bittle & Stoddard, LLC presented a brief background of the firm, depicting completed projects, experience and business relationships. Mr. Shulke introduced the Shulke, Bittle & Stoddard team consisting of Landscape Architect; Land Design South, Surveyor; Houston, Shulke, Bittle & Stoddard, LLC, Geotechnical Engineer; KSM Engineering & Testing, Inc., and Environmental Consultant; Bio-Tech. After the team introduction, a power point presentation was conducted. During the power point presentation, Mr. Shulke, outlined many of the firm's accomplishments illustrating the strong planning, landscaping and architectural services of their team member Land Design South and the teams' thorough understanding of the project and their project approach. Mr. Shulke presented a proposed conceptual redevelopment plan and illustration of the Main Street/Indian River Drive Redevelopment Project. After a brief question and answer session, the interviewed concluded at 10:05 a.m. Neel Schaffer 1201 I9`h Place, Suite A -100 Vero Beach, FL 32960 At 10:00 a.m., Peter Jones, Project Director, Neel -Schaffer conducted a brief background review of each team member and the firms overall diverse range of qualified experience. Mr. Jones conducted a power point presentation, outlining the key issues of the project such as; public involvement; planning and landscape architecture; traffic, parking and pedestrian circulation; environmental permitting and drainage. He also explained the firm's expertise in acquiring additional funding resources for special features to be designed into the project for future implementation. Mr. Stephen W. Boehning, P.E., briefly explained the civil engineering aspects and the implementation approach to this project. Mr. Fran Watanable, TE, explained his approach to the design and transportation planning of the project and the many challenging facets associated with the project. After a brief question and answer session, the interview concluded at 11:01 a.m. Keith &Schnars 900 East Ocean Blvd, Suite 340 E Stuart, FL 34994 At 11:12 a.m., Jack Breed, Vice President, Keith &Schnars summarized the background of each team member and the firms' long standing repeat relationships, responsiveness, cost efficiencies, on-time service and their project approach. During the power point presented by Keith &Schnars, many projects were illustrated `,, depicting their experience as it relates to parks, landscape architecture roadway design, traffic calming, transportation planning and the understanding of the Main Street/Indian ~ `~ River Drive Redevelopment Project. Mr. Jack Breed, discussed the firms' strong commitment to public involvement and discussed their proven methods of success. Since the cormittee had some concerns of the firms locality, Mr. Murphy emphasized and explained that whether their firm is local or not they will always provide straight up front answers to their clients and residents. He explained that their dedicated team covers the Treasure Coast and that they currently have an office in Pt. St. Lucie and soon to be opened office in Wabasso. After a few more questions by the committee members, the interview concluded at 12:05 PM. The committee took a short recess and upon reconvening, the committee discussed the ranking process. Each member then completed the predetermined ranking form and discussed their rankings with the other committee members. At the conclusion of this discussion, it was the unanimous consent of the committee to recommend to the CRA that Shulke, Bittle & Stoddard, LLC be ranked as the best qualified engineering firm and that authority be granted to begin contract negotiations. Tarbell, Executive Assistant Chairman, Al Minner called the meeting to order at 11:00 a.m. Mr. Minner briefly summarized the Committee's responsibility as it relates to the Consultant Competitive Negotiations Act "CCNA". Mr. Minner explained that the outcome of today's meeting would be to determine the top three (3) firms to be interviewed. Mr. Minner asked Committee Members to submit their ranking of each. engineering firm. After some discussion, each Committee Member verbally submitted their selection in ranking order, and gave a brief summary as to how they arrived at the individual ranking of each firm. Each firm was numerically ranked and at the conclusion, Al Minner totaled up the ranking points for each firm, which revealed the top three (3) firms. Committee Members concluded that each firm be scheduled for a one (1) hour interview and that thirty (30) minutes be allotted for a presentation and thirty (30) minutes for a question and answer session. Due to a scheduled overseas trip, Al Minner reported that Committee Member Shai Francis would not be available for the interview process. Therefore, Shai Francis withdrew her position as Committee Member. After a brief discussion it was the consensus of the Committee not to replace Shai and to proceed with four (4j members. Since Shai Francis withdrew from the Committee, Al Minner eliminated Shai's numerical rankings and recalculated the point rankings of each firm, revealing the same top three (3) firms as listed below. Additional Insured -The City is to be specifically included as an additional insured. Consultant's insurance including that applicable to the City as an Additional Insured shall apply on a primary basis and any other insurance maintained by the City shall be in excess of and shall not contribute with Consultant's insurance. The effects of growth and development have taken their toll on the large tracts of pristine wilderness located within Palm Beach County. The city and regional water resource managers retained some of the last parcels of land which were truly pris- tinewetlands. The Grassy Waters Preserve encompasses over 19 square miles and when joined with Apoxee Wilderness Preserve totals over 20 square miles of urban wilderness. The Wakodahatchee Wetlands is a 56 acre wetland park and was the first "created" wetland in Palm Beach County. Schulke, Bittle & Stoddard, L.L.C. has established professional working relationships with consultants who hold the same high standards in providing services that exceed clients' expectations. The majority of the designated consultants of this project are located under one roof (SBS, HSBS, Bio-Tech) and principals from four out of the five key consultants live and/or work in the city of Sebastian. Our local presence and experience, as well as our knowledge of local regulations and permitting requirements enable our design team to commence work immediately, communicate effectively, meet and address any unexpected circumstances, and ensure timely responses to design, permitting or construction issues. This ability will promote a positive working environment in every aspect of the project's development. With this research, Schulke, Bittle & Stoddard, LLC has gathered a wealth of information and insight as to the goals and objectives of this project. The Main Street/Indian River Drive Improvement Project is identified in the CRA as an area in need of revitalization and improved safety elements. Further, all those interviewed indicated, and our design team agreed, that this project is the center of the "Downtown" area and "Riverfront District". Therefore, it must be redeveloped in a manner that is first, functional, and second, a place in the city offering an ambiance and feel that will be uniquely Sebastian, a source of public pride, defining our fishing village heritage, and embracing and encouraging the use of its many assets; in particular, the Indian River Lagoon. We understand that these are needs that must be met by the City of Sebastian for the residents of the community. We must create a sense of place and provide an environment in which to enjoy the natural beauty and historical elements of the city's surroundings. The "Old Fishing Village" theme is important to the city, and the design requirements and criteria are clearly written to assure conformance with the City's Old Florida Fishing Village Theme. III. Site Visit A. SBS and Land Design South visited the site to generally view the current conditions, ascertain the existing functional problems with the boat ramp, document via photographs, confirm locations of specimen trees, structures, and confirm the type, location and use of other existing facilities. B. Bio-Tech Consulting visited the site to ascertain the shoreline conditions, upland/wetland limits, and significant vegetative communities (i.e. mangrove shoreline) IV. Reviewed the RFQ A. Reviewed the requested services B. Reviewed the Exhibit `A' conceptual plan V. Subsequently, we prepared a comparison of the current RF Conceptual Plan and our Alternative Conceptual Plan. We have identified where the concepts meet or fall short of the objectives considered most important to city staff and key community leaders. Schulke, Bittle & Stoddard, L.L.C. has prepared the attached alternative conceptual plan and evaluation with only a limited amount of time and resources. However, based on the information we have gathered, we believe we have made significant improvements to the City's plan -and know that if selected for this project, we will have the opportunity to further refine the conceptual plan. We believe this can be accomplished if an emphasis is placed on the following: • Work with the city residents, community and business leaders in a public forum - in an effort to further define the City's ideas and objectives. • Research all existing conditions; environmental, historical and cultural, survey and geotechnical data, which needs significant consideration during the planning phase. • Coordinate with public and private agencies early in the planning phase of the project, including: Indian River County Traffic Engineering and FDOT (impacts on US 1); SJRWMD, ACOE, FDEP, USFW, FWC (environmental impacts); Indian River County Department of Utilities (utility relocations); Chamber of Commerce (impacts to the Chamber site and parking), Indian River County Historical Society (historical and cultural resources), and city staff. We believe the following outlined objectives reflect the community's goals. We stress the importance of becoming very familiar with a project prior to entering into a contract. This will "flush out' most potential changes to the Scope of Services. Our approach is outlined as follows: 1. Define Requirements /Scope of Services /Responsibilities: - Define City of Sebastian requirements. - Research information available for the site or route for the proposed project improvements. - Gather existing data, including aerials, zoning maps, right-of-way maps, as-builts, etc. Meet with City of Sebastian staff to further define any potential issues. - Define our responsibilities and City of Sebastian responsibilities. - Establish a detailed Scope of Services. - Submit for City of Sebastian approval. 2. Contract Negotiation: - Incorporate and clearly define the requirements, services and responsibilities within the document. - Define an agreeable fee arrangement. 3. Performance: - Designate the Design Team, & clearly designate areas of responsibility for each team member. - Review task budgets with each member. - Review project status, production time and actual productivity vs. expected productivity. Design: - Ensure adequate attention is given to public needs, thoughts and ideas. - Meet and discuss the concepts early in the design with public and private agencies. - Ensure all existing data is incorporated in the design plans. - Check adequacy and completeness of the Consultants work. The design, in most instances, is only as good as the survey data and Geotechnical data provided. - Quality check all work during various stages of the design, and encourage the City of Sebastian engineer assigned to this project to further critique the plans. There is no room for pride at the expense of the Public. 2. Realistic Construction Budget: - Prepare an accurate construction cost estimate. Use recent site development pricing from similar projects recently bid. - During the preliminary design stage, the research information gathered will be utilized to its full advantage, allowing us to define a very accurate understanding of the construction proposed, and potentially avoid any issues that may otherwise be overlooked until final design is completed. Consequently, an accurate preliminary cost estimate is prepared that will set a realistic expectation of the construction cost. 3.
