This document will provide you authorization to continue providing volunteer aquatic life treatment services on ponds, swales, lakes and other water bodies in around the Keystone Drive area, as approximately depicted on the map attached hereto. The City recognizes that you take these activities on a volunteer basis and will provide all chemicals and labor at no charge to the City. Further, as applications are made, the City understands and you agree to keep current all required registrations and training as required for aquatic application from all regulatory agencies and Florida Statutes. As a volunteer for the City of Sebastian, you shall hold harmless the City of Sebastian, its agents, officers or representatives from any and all ciaims that may arise from treating aquatic life at the aforementioned location. You are hereby further informed that only you have authorization to apply such treatments and no other person or persons may accompany you in this process. This Agreement shall be in fuli force and effect untii December 31, 2013. This Agreement will be reviewed on an annual basis. Please sign and return a copy of this Agreement, as your signature indicates your concurrence with these terms. A current copy of all application certificates is also needed at this time. Also, note that a copy of this agreement will remain in the City Attorney's office and be on file with the City Clerk, City Manager, Public Works Director and Police Chief. Also the label for the glyphosate based chemical that I am currently using (Rodeo). At this time my plans are to use only the "Rodeo" and, if necessary, the diquat based chemical "Reward". I aiso have the current Hold Harmless Agreement. My plan is to take back the lake and the canals. If possible, could you get Mr. Converse to knock down the growth in the NW canal from the lake at least to the overflow, as I would like to get this area treated within the next couple of weeks. The taking back of the lake will take some time and it probably will look worse before it gets better. However, we both realize that this is the best for the water quality and the overall general health of the system. I would suggest that if someone has a problem with this agenda then they should get the state or other authority to contact me. I will not, however, deal with anyone not associated with an official entity. Thank you for your continued support. STABILITY AND REACTIVITY Chemical Stability: This material is stable under normal handling and storage conditions. Conditions to Avoid: Excessive heat. Do not store near heat or flame. Glyphosate is readily degraded by soil microbes to AMPA (aminomethyl phosphonic acid) that is further degraded to carbon dioxide. Glyphosate and AMPA are unlikely to enter ground water due to their strong adsorptive characteristics. Terrestrially-applied glyphosate has the potential to move into surface waters through soil erosion because it may be adsorbed to soil particles suspended in the runoff. Aquatic applications registered for certain formulations may also result in glyphosate entering surface waters. Complete degradation is slow, but dissipation in Page 4 of 6 April 5, 2007 MATERIAL SAFETY DATA SHEET AquaNeat Aquatic Herbicide water is rapid because glyphosate is bound in sediments and has low biological availability to aquatic organisms. These characteristics suggest a low potential for bioconcentration in aquatic organisms and this has been verified by laboratory investigations of glyphosate bioconcentration in numerous marine and freshwater organisms with and without soil. The maximum whole body bioconcentration factors for fish were observed to be less than 1X. Bioconcentration factors for sediment dwelling mollusks and cra�sh tended to be slightly higher, but were always less than 10X. In addition, any residues accumulated in organisms were rapidly eliminated. 13. DISPOSAL CONSIDERATIONS Waste Disposal Method: Wastes resulting from the use of this product that cannot be used or chemically reprocessed should be disposed of in a landfill approved for pesticide disposal or in accordance with applicable Federal, state or local procedures. Emptied container retains vapor and product residue. Observe all label safeguards until container is destroyed. Container Handlin� and Disposal: Plastic Bottles and Non-Returnable Plastic Drums: Do not reuse container. Triple rinse container. Then puncture and dispose of in a sanitary landfill, or by incineration, or, if allowed by state and local authorities, by burning. If burned, stay out of smoke. Returnable/Refillable Containers: Close all openings which have been opened during use and replace all caps. This document will provide you authorization to continue volunteer aquatic life treatment on ponds, swales, lakes and other like water bodies in an around the Keystone Drive area, as approximately depicted on the map attached hereto. The City recognizes that you take these activities on a volunteer basis and will provide all chemicals and labor at no charge to the City. Further, as applications are made, the City understands and you agree to keep current all required registrations and training as required for aquatic application from all regulatory agencies and Florida Statutes. Finally, as a volunteer for the City of Sebastian, you shall hold harmless the City of Sebastian, its agents, officers or representatives from any and all claims that may arise from treating aquatic life at the aforementioned location. You are hereby further informed that only you have authorization to apply such treatments and no other person or persons may accompany you in this process. This Agreement shall be in full force and effect until December 31, 2009. This agreement will be reviewed on an annual basis. Please sign and return a copy of this Agreement, as your signature indicates your concurrence with these terms.
