Rose Deigl /President & CEO 69414 th Street Vero Beach, Florida 32960 And City of Sebastian c/o Al Minner, City Manager 1225 Main Street Sebastian, FL 32958 The City of Sebastian agrees to maintain the waste management for the public transit bus shelters (hereinafter referred to as "Bus Shelters "), located with the city limits provided by the Senior Resource Association, Inc. in accordance to the following terms and conditions. 1. TERMS OF THE AGREEMENT This agreement shall commence on the effective date and shall remain as an ongoing service for the Senior Resource Association, Inc., by the City of Sebastian. This agreement may be cancelled by either party with thirty (30) days written notice. 2. BUS SHELTERS ELIGIBLE FOR MAINTENANCE Bus Shelters included in this agreement will consist of all shelters placed by the Senior Bus Resource Association, Inc. within the City of Sebastian. The number and location of all bus shelters within the city of Sebastian must be approved by the City Manager prior to their placement. 3. SERVICES PROVIDED The City of Sebastian agrees to maintain the removal of waste from all bus shelter trash receptacles and within the perimeter of the shelter and keep the grounds in proper appearance surrounding the shelters. The Senior Resources Association, Inc. will be responsible for the elimination of graffiti and repair of any damage. We have carefully reviewed this contract and agree to and accept its terms and conditions. We are executing this agreement as of the effective date above. SENIOR RESOURCE ASSOCIATION, INC. Karen B. As such, I have attached the enclosed map and executed Bus Agreement. The City does want to review this agreement again, when Senior Resources decides to add other shelters in Sebastian. Let me know if you have any questions. I think this wraps up the agreement for now. Rose Deigl President & CEO Senior Resources Association 694 14th Street Vero Beach, FL 32960 Dear Ms. Deigl Please find attached an executed copy of the Bus Shelter Maintenance Agreement between the City of Sebastian and Senior Resources. The City has reviewed the Bus Shelter locations and per the attach map agrees with the Sebastian locations noted as #17 and #18. The City requests that should any other bus shelters be added, additional review /consent will be required by the City, prior to locating such shelters. Bob Ginsburg, City Attorney, has determined that a hold harmless will not be requested by the City for shelter locations #17 and #18; however, the City reserves the right to require such for future locations.
