HomeMy WebLinkAbout2011 - 4th Lease AmendmentFOURTH AMENDMENT OF AVIATION LEASE AGREEMENT THIS FOURTH AMENDMENT of the AIRPORT AVIATION LEASE AGREEMENT (hereinafter "Lease ") by and between the CITY OF SEBASTIAN (hereinafter "Landlord ") and LoPresti Aviation (hereinafter "Tenant ") dated 2 April 2008, and provides as follows: WITNESSETH: WHEREAS, the Landlord is the owner of certain property located in Indian River County, Florida; and WHEREAS, the Landlord agreed to lease such property under the terms of the Lease to Tenant; and. WHEREAS, the Tenant wishes to add to, and modify, Section 2 of said Lease; and, WHEREAS, Landlord and Tenant are mutually agreeable to said modification; NOW, THEREFORE, in consideration of the mutual covenants hereinafter provided, the receipt and sufficiency of which are hereby acknowledged, the parties have agreed as follows: 1. Section 2 of the Lease is hereby amended by the addition of the following: 2. LEASED PREMISES. Leased premises shall include a 10' x 12' office in the current airport administration wing. 2. This is month -to -month modification to the underlying lease concerning the subject office space only. The rent shall be a fixed price of $125 per month. A fixed utility charge of $50 per month shall apply. 3. Premises are furnished, as is. The Landlord and Tenant will exchange an inventory of the furnishings that will include the condition of said furnishings. Modifications of said office space shall be at the expense of LoPresti. Any modifications will have the prior written permission of the Airport Director. 5. All other provisions to the lease shall apply.
