Mrs. Damp called for nominations. Mr. Halloran nominated Mr. Taracka
and Mr. Barnes nominated Mrs. Cartwright. Mrs. Damp closed
nominations.
The City Clerk called the roll. Mr. Taracka declined his nomination and the
vote was discontinued.
In accordance with Section 2.06(a)(2), by virtue of no other nomination,
Mrs. Cartwright was elected Mayor.
D. Appointment of Vice Mayor
Mrs. Damp called for nominations. Mayor Cartwright nominated Mr.
Barnes and there were no other nominations. In accordance with Section
2.06 (d), by virtue of no other nomination, Mr. Barnes was elected Vice-
Mayor.
The City Attorney advised that the election of Mayor and Vice-Mayor be
formally confirmed at the next regular meeting in keeping with certain
provisions of the Charter.

This is a bill for the city ' s share of elections expenses
for the March 12 , 1996 , election. Based on the agreed
upon rate of 60 per registered voter, please send a check
payable to the Supervisor of Elections in the amount of
$5 , 012 .40 ( 8 , 354 x 60 ) .
Only when we are holding a countywide election on the same
day as your city election does this rate apply. For every
other city election, the expense of each item in an election
is allocated to each city based on the number of precincts ,
the number of ballot pages , the number of poll workers , etc .
Enclosed are the book-closing figures , a sample ballot , a
list of the polling places , and a copy of the memo sent to
the news media and to each of your candidates .
The County Canvassing Board composed of a county judge, the
chairman of the county commission, and the supervisor of
elections will canvass the ballots , including the absentees ,
for the March 12 election because it is a countywide election .
We will look forward to seeing you on election day to help
process the ballots .

RESOLUTION NO. R-96-30
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL
ELECTION; PROVIDING FOR CANVASSING OF ELECTION
RETURNS; PROVIDING FOR DECLARATION OF RESULTS;
DIRECTING THE CLERK TO ENTER THE RESULTS OF THE
ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF
THE CITY COUNCIL; PROVIDING FOR REPEAL OF
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Sebastian, at its January 24, 1996
Regular Meeting, adopted Ordinance Nos. 0-96-03, 0-96-04 and 0-96-05 placing
referendum questions to amend the City Charter on the March 12, 1996 ballot; and
WHEREAS, the Mayor of the City of Sebastian, pursuant to Section 4.05 of the
City Charter, issued a Proclamation on January 24, 1996, calling a general election on
March 12, 1996, for the purpose of selecting two (2) City Council members and placing
three referendum questions on the ballot; and
WHEREAS,the City Council of the City of Sebastian, pursuant to Section 4.07 of
the City Charter, adopted Resolution No. R-96-06 on January 24, 1996, specifying
Precincts 12, 14, 15 and 16 as the official polling places for the City of Sebastian for the
general election, naming the offices to be filled, and questions to be decided; and
• •
WHEREAS, pursuant to Section 4.08 of the City Charter, the Supervisor of
Elections for Indian River County has appointed a Canvassing Board and said Canvassing
Board shall certify to the City Council the results of the voting at each polling place as well
as the results of any absentee votes cast; and
WHEREAS,the City Clerk of the City of Sebastian, pursuant to Section 100.021
of the Florida Statutes, has caused to be published notice of the general election on
December 15 and 29, 1995, in the Vero Beach Press Journal, a newspaper of general
circulation; and
WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.342 of
the Florida Statutes, has caused to be published notice of three referendum questions to
amend the City Charter on February 5 and 19, 1996; and
WHEREAS,the City Clerk has posted notice of the general election on the official
announcement board located at City Hall; and
WHEREAS, Precincts 12, 14, 15 and 16 of the City of Sebastian, Indian River
County, Florida, held a general election on March 12, 1996; and
WHEREAS, the Canvassing Board has verified said returns and has found the same
in proper form.
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:

SECTION 1. DECLARATION. The City Council of the City of Sebastian, Indian
River County, Florida, hereby accepts the returns provided by the Canvassing Board for
the general election, held on March 12, 1996, in Precincts 12, 14, 15, and 16 of the City of
Sebastian, as attached hereto as Exhibit "A".
SECTION 2. RECORDING. The City Clerk is hereby directed to enter the results
election in the official minutes of the City Council meeting during which

SECTION 3. CONFLICT. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
SECTION 4. EFFECTIVE DATE. This resolution shall take effect immediately
upon its passage.

Summary Statement: In accordance with Section 4.08(c) of the City Charter, "The
City Council shall hold a Special Meeting on the first Monday following the
election for the purpose of receiving the certificate of the county canvassing board
of the returns for Indian River County, Florida, or the city canvassing board, as
the case may be. The City Council shall then declare the results of the election
and enter them in the minutes of the special meeting. "
Recommended Action: Adoption of Resolution No. R-96-30, certificate of
canvassing board, by the current City Council.

2) Investiture of Newly Elected Officials
Summary Statement: In accordance with Section 2.04(b) of the City Charter, "The
term of each newly elected council member shall begin on the Monday following
the election, at a special meeting of the city council to be held for the purpose of
swearing in such newly elected officials. If a regular meeting is to be held the
Monday following the election, the newly elected officials shall be sworn in at the
conclusion of such regular meeting. "
Section 4.08(c) continues "Any oath of office required to be administered to the
newly elected council members shall be administered at such special meeting or at
the next city council meeting where the newly elected council members are in
attendance."
Recommended Action: The City Clerk will swear in newly elected officials who
will take their places at the dais.
3) Election of Mayor
Summary Statement: In accordance with Section 2.06 of the City Charter, "...after
the seating of any newly elected council members, at the first scheduled city
council meeting subsequent to the second Tuesday in March, the new city council
shall, as the first order of business, elect a mayor form among its members. The
incumbent mayor or in his or her absence, the vice-mayor or in his or her
absence, the senior member of city council, shall ask for nominations for mayor.
After all nominations have been made, the nominations shall be closed. The city
clerk shall then call the roll of the council members and each council member
shall cast an affirmative vote for the council member of their choice. The council
member that receives a majority of the votes cast on the first ballot, balloting with
sequential roll calls shall continue until a council member receives a majority
vote. Council members shall not nominate themselves. Only elected council
members shall be eligible for the office of mayor. (1) If there is no mayor seated
on the new or existing city council, a temporary city council chairperson may be
elected from the incumbent members of the city council for the purpose of electing
a mayor as set forth above. (2) In the event there is only one nomination and
second for mayor, the nominee shall be seated as mayor. "
Recommended Action: The senior member of Council shall ask for nominations
for Mayor. The City Clerk will then call the roll on each nominee and each
Council member shall vote in the affirmative for the nominee of his/her choice.
When a majority is received, that person shall be elected Mayor.

4) Election of Vice Mayor
Summary Statement: In accordance with Section 2.06(c), "At the first regularly

city council shall elect a vice-mayor from among its members. The term of the
vice-mayor shall be for one year or until his or her successor is elected. The vice-
mayor shall be elected using the same procedure as for the election of the mayor. "

Vice-Mayor. The City Clerk will then call the roll on each nominee and each
Council member should vote in the affirmative for the nominee of his/her choice.
When a majority is received, that person shall be elected Vice-Mayor.

The City Council will conduct a Special Meeting on Monday, March 18, 1996 at 5:00
p.m. in the City Council Chambers, City Hall, 1225 Main Street, Sebastian, Florida.
The purpose of the Special Meeting is for the current Council to certify election results,
the swearing in of the newly elected Council members and election of Mayor and Vice
Mayor by the new Council.
Any person who decides to appeal any decision made by the City Council with respect to
any matter considered at this meeting (or hearing) will need a record of the proceedings
and may need to ensure that a verbatim record of the proceedings is made, which record
includes the testimony and evidence upon which the appeal is to be heard (286.0105
F.S.)

SUMMARY
Pursuant to Section 4.08 (c) of the City Charter, the City Council shall hold a special meeting
on the first Monday following the election for the purpose of receiving the certificate of the
County or City canvassing board, as the case may be. The City Council shall then declare
the results of the election and enter them into the minutes of the special meeting. Any oath

Additionally, pursuant to Section 2.06 of the City Charter, the newly seated council would
then elect a Mayor with the election of a Vice Mayor to occur at the first regularly scheduled
meeting subsequent to the second Tuesday in March.
Normally, the meeting would be held at 7:00 P.M., on Monday, March 18, 1996. Due to a
time conflict, Vice Mayor Corum has requested that the Council consider changing the
starting time of the special meeting from 7:00 P.M. to 5:00 P.M.
RECOMMENDATION
Inasmuch as this is Vice Mayor Corum's last meeting, it would be appropriate to adjust
the time of the special council meeting from 7:00 P.M. to 5:00 P.M.

COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL
ELECTION; PROVIDING FOR CANVASSING OF ELECTION
RETURNS; PROVIDING FOR DECLARATION OF RESULTS;
DIRECTING THE CLERK TO ENTER THE RESULTS OF THE
ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF
THE CITY COUNCIL; PROVIDING FOR REPEAL OF
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Sebastian, at its January 24, 1996
Regular Meeting, adopted Ordinance Nos. 0-96-03, 0-96-04 and 0-96-05 placing
referendum questions to amend the City Charter on the March 12, 1996 ballot; and
WHEREAS, the Mayor of the City of Sebastian, pursuant to Section 4.05 of the
City Charter, issued a Proclamation on January 24, 1996, calling a general election on
March 12, 1996, for the purpose of selecting two (2) City Council members and placing
three referendum questions on the ballot; and
WHEREAS,the City Council of the City of Sebastian, pursuant to Section 4.07 of
the City Charter, adopted Resolution No. R-96-06 on January 24, 1996, specifying
Precincts 12, 14, 15 and 16 as the official polling places for the City of Sebastian for the
general election, naming the offices to be filled, and questions to be decided; and
• •
WHEREAS, pursuant to Section 4.08 of the City Charter, the Supervisor of
Elections for Indian River County has appointed a Canvassing Board and said Canvassing
Board shall certify to the City Council the results of the voting at each polling place as well
as the results of any absentee votes cast; and
WHEREAS,the City Clerk of the City of Sebastian, pursuant to Section 100.021
of the Florida Statutes, has caused to be published notice of the general election on
December 15 and 29, 1995, in the Vero Beach Press Journal, a newspaper of general
circulation; and
WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.342 of
the Florida Statutes, has caused to be published notice of three referendum questions to
amend the City Charter on February 5 and 19, 1996; and
WHEREAS,the City Clerk has posted notice of the general election on the official
announcement board located at City Hall; and
WHEREAS, Precincts 12, 14, 15 and 16 of the City of Sebastian, Indian River
County, Florida, held a general election on March 12, 1996; and
WHEREAS, the Canvassing Board has verified said returns and has found the same
in proper form.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:

SECTION 1. DECLARATION. The City Council of the City of Sebastian, Indian
River County, Florida, hereby accepts the returns provided by the Canvassing Board for
the general election, held on March 12, 1996, in Precincts 12, 14, 15, and 16 of the City of
Sebastian, as attached hereto as Exhibit "A".
SECTION 2. RECORDING. The City Clerk is hereby directed to enter the results
of the general election in the official minutes of the City Council meeting during which this
Resolution is adopted.
SECTION 3. CONFLICT. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
SECTION 4. EFFECTIVE DATE. This resolution shall take effect immediately
upon its passage.
The foregoing Resolution was moved for adoption by Councilmember

I am attaching a copy of an official notification from Larry Driver stating he will not be a
candidate for the election March 12, 1996.
The date of the notification, February 23, was 18 days before the election. 101.25 F.S. addresses
events of removal of names 42 and 21 days before an election but there is no direction after 21
days.
I have spoken to Ann Robinson, Supervisor of Elections, Indian River County and also Ethel
Baxter, Division of Elections, State of Florida. I am receiving conflicting recommendations.
Ethel Baxter made reference to an election that had Bob Graham's name on the ballot and he was
not a candidate, however, the ballots were counted. She did not elaborate on this issue.
I realize you are very busy but elections in Sebastian are very touchy issues and I feel an opinion
from the City Attorney is vital in this case.

PROCLAMATION
WHEREAS, Section 4.05 of the Charter of the City of Sebastian, Indian
River County, Florida requires that all elections shall be called by a proclamation
of the Mayor; and
WHEREAS,the current terms of two City Council members are scheduled
to expire in March 1996; and
WHEREAS, the City Council has placed certain referendum questions on
the ballot by adoption of Ordinance Nos. 0-96-03, 0-96-04 and 0-96-05.
NOW,THEREFORE,I,Arthur L.Firtion,by virtue of the authority vested
in me as Mayor of the City of Sebastian,Florida, do hereby proclaim that a general
election of the City of Sebastian for the two City Council offices and certain
referendum questions will be held in the City of Sebastian on the 12th day of March,
1996.

RESOLUTION NO. R-96-06
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA DESIGNATING 1HE OFFICIAL POLLING
PLACES FOR A GENERAL ELECTION TO BE HELD ON MARCH
12, 1996, FOR THE PURPOSE OF ELECTING TWO (2) CITY
COUNCIL MEMBERS FOR TERMS OF TWO (2) YEARS AND
PLACING CERTAIN REFERENDUM QUESTIONS ON THE
BALLOT;PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS
OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Mayor of the City of Sebastian has called, by proclamation, a
General Election to be held within the City of Sebastian, Indian River County, Florida on
Tuesday, March 12, 1996.
WHEREAS, Section 4.07 of the Charter of the City of Sebastian, Florida, requires
the City Council of the City of Sebastian to adopt a Resolution upon the calling of an
election designating polling places, offices to be filled and questions to be decided; and
WHEREAS, Section 2.03 of the Charter of the City of Sebastian, Florida, calls for
the election of two (2) council members on the second Tuesday in March of each
even-numbered year and of three (3) council members in each odd-numbered year; and

WHEREAS, the City Council, at its January 24, 1996 Regular Meeting, adopted
Ordinance Nos. 0-96-03, 0-96-04 and 0-96-05, which place referendum questions on the
March 12, 1996 ballot.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA as follows:
Section 1. CALLING OF THE ELECTION. An election will be held within the
City limits of the City of Sebastian, Indian River County, Florida, on Tuesday, March 12,
1996.
Section 2. POLLING PLACES. The four polling places for the City of Sebastian
are as follows:
A. Precinct 12 The Sebastian Community Center, 1805 North Central
Avenue
B. Precinct 14 First Church of the Nazarene 50 South Wimbrow Drive
C. Precinct 15 The North Indian River County Library, 1001 Fellsmere
Road (CR 512)
D. Precinct 16 Sebastian Elks Lodge #2714, 731 South Fleming Street
Section 3. ELECTION OF OFFICERS. The terms of two (2) Council
members will expire in March 1996, therefore, in accordance with Section 2.03 of the
Charter of the City of Sebastian, Florida, a general election will be held to elect two (2)
Council members for terms of two (2) years, commencing on March 18, 1996.

Section 4. REFERENDUM QUESTIONS. Ordinance Nos. 0-96-03, 0-96-04
and 0-96-05, adopted January 24, 1996, place referendum questions on the March 12, 1996
ballot. Questions to be placed on the ballot are as follows:
a. Referendum No. 3: - APPOINTMENT OF CITY CLERK BY CITY
MANAGER
Shall the City of Sebastian amend the City Charter to provide that the city
manager have the authority to appoint the city clerk and the authority to
remove the city clerk with the consent of the city council, and that the city
manager shall have the authority to appoint the city election canvassing board,
and to conform remaining provisions with the amendments?

River County, Florida, has determined that certain revisions should
be made to the City Charter in order to provide that the city clerk
shall be appointed by the city manager and may be removed by the
city manager with the consent of the city council, amending Article
III regarding the duties of the city manager, and amending Article
IV regarding appointment of a city canvassing board; and
WHEREAS, the City Council desires to submit the amendments to
the City Charter for ratification by the electors of the City of
Sebastian, Indian River County, Florida.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows :

be removed by a majority vote of the city council after a public

Section 3 . 04 . City manager; powers and duties .
(a) The city manager shall be the executive officer

and the chief adminiStrative officer of the city. The city manager
shall , as the executive officer of the city, require the laws and
ordinances of the city to be faithfully executed and enforced, and
as the chief administrative officer, shall implement the policies
of the city council as promulgated from time to time .
(b) The city manager, when necessary, shall
appoint , suspend, demote, or dismiss any city employee under his
jurisdiction in accordance with the law and the personnel rules of
the city and may authorize any department head to exercise these
powers with respect to subordinates in his respective department .
(c) The city manager shall direct and supervise the
administration of all departments of the city except the office of
the city attorney. He shall attend all city council meetings
unless excused by the mayor or city council and shall have the
right to take part in discussions , but not vote .
(d) The city manager shall see that all laws,
Charter provisions , ordinances, resolutions, and other acts of the
city council subject to enforcement by the city manager are
faithfully executed.
(e) The city manager shall submit the annual
budget, budget message , and capital improvement program budget to
the city council and shall keep the city council fully advised as
to the financial condition and future needs of the city, and shall
make such recommendations to the city council concerning the
affairs of the city as he deems desirable .
(f) The city manager shall designate a qualified

city employee to exercise the powers and perform the duties of city
manager during any temporary absence or disability of the city
manager. The city council may revoke such designation at any time
and appoint another eligible person, other than a sitting council
member, to serve as acting city manager.
(g) The city manager, as authorized by the city
Charter, the Sebastian Code of Ordinances , or by the direction of
the city council, may sign all contracts , bonds, debentures,
franchises and official documents on behalf of the city, which
shall also be attested by the city clerk.
Section 3 . 05 . City clerk.
There shall be a city clerk appointed by the city manager
who shall give notice of city council meetings to its members and
the public, keep the journal of its proceedings and perform such
other duties as are assigned to the clerk by the city manager. The
city clerk may be removed by the city manager if the removal is
approved by the city council .
Section 2 . That upon passage of Referendum No . 3 , the
existing Section 4 . 08 (a) of the City Charter of the City of
Sebastian, Florida, shall be amended to read as follows :
(a) If the city is not holding its election as a
part of the election for Indian River County, Florida, the city
manager shall appoint a city canvassing board to be composed of
three (3 ) individuals; one (1) member shall be the city clerk and
the remaining two (2) members shall be electors of the city
appointed by the city manager. The city clerk shall act as

chairperson of the city canvassing board.
Section 3 . An election is hereby called and scheduled to
be held on March 12 , 1996 , to determine whether the revisions to
the City Charter of the City of Sebastian, Florida shall be
approved by a majority of the votes cast in such *ion, in which
the qualified electors residing in the City of Sebastian shall
participate .
Section 4 . The places of voting in such election shall be the
usual places of voting in the City of Sebastian, Florida, in the
regular election as determined under the applicable provisions of
Florida law, which are currently as follows :

existing Section 1 . 02 (7) of the City Charter of the City of
Sebastian, Florida, shall be amended to read as follows :
(7) Airports . To purchase, acquire, take, hold,
establish, construct, equip, maintain and operate municipal
airports, landing fields , hangars, aviation terminals and

administration buildings, runways, depots , warehouses, garages,
repair shoos, oil and fuel tanks or stations , or other necessary
appurtenances for the use of airplanes and other aircraft, and to
acquire or lease any and all real property within the corporate
limits , or within ten (10) miles of the boundaries thereof, for
such purpose; to set apart and use for such purpose any real
property owned or leased by the city, whether or not originally
acquired by condemnation, purchase or lease for another purpose; to
adopt and enforce reasonable rules and regulations governing the
use of such municipal airports ; to employ airport directors,
airport managers , employees or agents in connection with such
operation; to impose fees or charges in connection with the use of
such airport or airport facilities ; to sell gasoline or other
supplies necessary in connection with the operation of such
airports ; to provide lounges, eating places, refreshment parlors
and other facilities in connection with such municipal airport ; to
let or lease to private persons or corporations portions of said
airports for building sites, hangar space, concessions or other
uses for a term not to exceed fifty (50) years ; to prescribe and
promulgate reasonable rules and regulations for the operation; to
accept and receive grants from the state and federal governments
and any body politic for the construction, maintenance, operation
and management of such airport facilities .
Section 2 . An election is hereby called and scheduled to be
held on March 12 , 1996 , to determine whether the revisions to the
City Charter of the City of Sebastian, Florida shall be approved by

RE: ANY MUNICIPAL ELECTIONS TO BE HELD ON MARCH 12 , 1996
We need a formal request from each municipality in order for
us to administer a municipal election on March 12 , 1996.
The Presidential Preference Primary , a countywide election ,
will be held on March 12 this year, also. Because the County
is holding an election, the charge for administering each
municipal election will be 60C per registered voter on the
day that the books close, February 13 , rather than the entire
expense being charged to the municipalities as it is when no
countywide election is being held.
The canvassing board for the March 12 election will be comprised
of the chairman of the Board of County Commissioners , a county
judge, and the supervisor of elections .
The absentee ballots for military and overseas civilian voters
for the March 12 election must be mailed on February 6 , 1996 ,
so each municipality must notify us in writing of its request
for us to administer the election as well as notifying us in
writing of its candidates and issues to be placed on the ballot .

SUMMARY STATEMENT
The City Council, each year, is required to call the general election by proclamation(in
acccordance with Section 4.05 of the City Charter); adopt a resolution stating therein where the
election shall be held, the offices to be filled, and questions to be decided (in accordance with
Section 4.07 of the City Charter); and formally request the Supervisor of Elections to administer
the City's election. If Indian River County is not conducting an election at the same time as the
City's general election, the City Clerk appoints canvassing board members and brings it to the
City Council for affirmation. This year Indian River County will provide canvassing board
members.
Due to the placement of the public hearing and adoption of the Charter amendments on this
agenda and pending the outcome of each, certain electio n matters to be approved at this meetin g
may be subject to change. This item has been prepared under the assumption that all Charter
amendments will be adopted by the City Council.

I will be requesting payment to the Supervisor of Elections subsequent to the election, when I
have received a breakdown of costs and a bill. Election costs will be shared by Indian River
County and those municipalities holding elections in March.
RECOMMENDATION
1) Mayor Firtion calls the March 12, 1996 election by proclamation.
2) Adopt Resolution No. R-96-06.
3) Formally request the Supervisor of Elections for Indian River County to administer the
