Based on the agreed upon rate of 60 per registered voter, please send a check payable to the Supervisor of Elections in the amount of $5 , 012 .40 ( 8 , 354 x 60 ) . Only when we are holding a countywide election on the same day as your city election does this rate apply. For every other city election, the expense of each item in an election is allocated to each city based on the number of precincts , the number of ballot pages , the number of poll workers , etc . Enclosed are the book-closing figures , a sample ballot , a list of the polling places , and a copy of the memo sent to the news media and to each of your candidates . The County Canvassing Board composed of a county judge, the chairman of the county commission, and the supervisor of elections will canvass the ballots , including the absentees , for the March 12 election because it is a countywide election . R-96-30 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL ELECTION; PROVIDING FOR CANVASSING OF ELECTION RETURNS; PROVIDING FOR DECLARATION OF RESULTS; DIRECTING THE CLERK TO ENTER THE RESULTS OF THE ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF THE CITY COUNCIL; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Sebastian, at its January 24, 1996 Regular Meeting, adopted Ordinance Nos. 0-96-03, 0-96-04 and 0-96-05 placing referendum questions to amend the City Charter on the March 12, 1996 ballot; and WHEREAS, the Mayor of the City of Sebastian, pursuant to Section 4.05 of the City Charter, issued a Proclamation on January 24, 1996, calling a general election on March 12, 1996, for the purpose of selecting two (2) City Council members and placing three referendum questions on the ballot; and WHEREAS,the City Council of the City of Sebastian, pursuant to Section 4.07 of the City Charter, adopted Resolution No. R-96-06 on January 24, 1996, specifying Precincts 12, 14, 15 and 16 as the official polling places for the City of Sebastian for the general election, naming the offices to be filled, and questions to be decided; and • • WHEREAS, pursuant to Section 4.08 of the City Charter, the Supervisor of Elections for Indian River County has appointed a Canvassing Board and said Canvassing Board shall certify to the City Council the results of the voting at each polling place as well as the results of any absentee votes cast; and WHEREAS,the City Clerk of the City of Sebastian, pursuant to Section 100.021 of the Florida Statutes, has caused to be published notice of the general election on December 15 and 29, 1995, in the Vero Beach Press Journal, a newspaper of general circulation; and WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.342 of the Florida Statutes, has caused to be published notice of three referendum questions to amend the City Charter on February 5 and 19, 1996; and WHEREAS,the City Clerk has posted notice of the general election on the official announcement board located at City Hall; and WHEREAS, Precincts 12, 14, 15 and 16 of the City of Sebastian, Indian River County, Florida, held a general election on March 12, 1996; and WHEREAS, the Canvassing Board has verified said returns and has found the same in proper form. NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: 2 • • • • SECTION 1. DECLARATION. The City Council shall then declare the results of the election and enter them in the minutes of the special meeting. " Recommended Action: Adoption of Resolution No. R-96-30, certificate of canvassing board, by the current City Council. • • 2) Investiture of Newly Elected Officials Summary Statement: In accordance with Section 2.04(b) of the City Charter, "The term of each newly elected council member shall begin on the Monday following the election, at a special meeting of the city council to be held for the purpose of swearing in such newly elected officials. If a regular meeting is to be held the Monday following the election, the newly elected officials shall be sworn in at the conclusion of such regular meeting. " Section 4.08(c) continues "Any oath of office required to be administered to the newly elected council members shall be administered at such special meeting or at the next city council meeting where the newly elected council members are in attendance." Recommended Action: The City Clerk will swear in newly elected officials who will take their places at the dais. 3) Election of Mayor Summary Statement: In accordance with Section 2.06 of the City Charter, "...after the seating of any newly elected council members, at the first scheduled city council meeting subsequent to the second Tuesday in March, the new city council shall, as the first order of business, elect a mayor form among its members. The incumbent mayor or in his or her absence, the vice-mayor or in his or her absence, the senior member of city council, shall ask for nominations for mayor. After all nominations have been made, the nominations shall be closed. The city clerk shall then call the roll of the council members and each council member shall cast an affirmative vote for the council member of their choice. The council member that receives a majority of the votes cast on the first ballot, balloting with sequential roll calls shall continue until a council member receives a majority vote. Council members shall not nominate themselves. Only elected council members shall be eligible for the office of mayor. (1) If there is no mayor seated on the new or existing city council, a temporary city council chairperson may be elected from the incumbent members of the city council for the purpose of electing a mayor as set forth above. (2) In the event there is only one nomination and second for mayor, the nominee shall be seated as mayor. " Recommended Action: The senior member of Council shall ask for nominations for Mayor. (b) The city manager, when necessary, shall appoint , suspend, demote, or dismiss any city employee under his jurisdiction in accordance with the law and the personnel rules of the city and may authorize any department head to exercise these powers with respect to subordinates in his respective department . (c) The city manager shall direct and supervise the administration of all departments of the city except the office of the city attorney. He shall attend all city council meetings unless excused by the mayor or city council and shall have the right to take part in discussions , but not vote . (d) The city manager shall see that all laws, Charter provisions , ordinances, resolutions, and other acts of the city council subject to enforcement by the city manager are faithfully executed. (e) The city manager shall submit the annual budget, budget message , and capital improvement program budget to the city council and shall keep the city council fully advised as to the financial condition and future needs of the city, and shall make such recommendations to the city council concerning the affairs of the city as he deems desirable . (f) The city manager shall designate a qualified j • • 4 410 city employee to exercise the powers and perform the duties of city manager during any temporary absence or disability of the city manager. The city council may revoke such designation at any time and appoint another eligible person, other than a sitting council member, to serve as acting city manager. (g) The city manager, as authorized by the city Charter, the Sebastian Code of Ordinances , or by the direction of the city council, may sign all contracts , bonds, debentures, franchises and official documents on behalf of the city, which shall also be attested by the city clerk. Section 3 . 05 . City clerk. There shall be a city clerk appointed by the city manager who shall give notice of city council meetings to its members and the public, keep the journal of its proceedings and perform such other duties as are assigned to the clerk by the city manager. The city clerk may be removed by the city manager if the removal is approved by the city council . Section 2 . That upon passage of Referendum No . 3 , the existing Section 4 . 08 (a) of the City Charter of the City of Sebastian, Florida, shall be amended to read as follows : (a) If the city is not holding its election as a part of the election for Indian River County, Florida, the city manager shall appoint a city canvassing board to be composed of three (3 ) individuals; one (1) member shall be the city clerk and the remaining two (2) members shall be electors of the city appointed by the city manager. The Presidential Preference Primary , a countywide election , will be held on March 12 this year, also. Because the County is holding an election, the charge for administering each municipal election will be 60C per registered voter on the day that the books close, February 13 , rather than the entire expense being charged to the municipalities as it is when no countywide election is being held. The canvassing board for the March 12 election will be comprised of the chairman of the Board of County Commissioners , a county judge, and the supervisor of elections . The absentee ballots for military and overseas civilian voters for the March 12 election must be mailed on February 6 , 1996 , so each municipality must notify us in writing of its request for us to administer the election as well as notifying us in writing of its candidates and issues to be placed on the ballot .
