R-98-12 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA,PERTAINING TO THE MUNICIPAL ELECTION; PROVIDING FOR CANVASSING OF ELECTION RETURNS;PROVIDING FOR DECLARATION OF RESULTS; DIRECTING THE CLERK TO ENTER THE RESULTS OF THE ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF THE CITY COUNCIL; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN El fl CTIVE DATE. WHEREAS,the Mayor of the City of Sebastian,pursuant to Section 4.05 of the City Charter,issued a Proclamation on January 28, 1998,calling a general election on March 10, 1998,for the purpose of selecting two(2) City Council members; and WHEREAS,the City Council of the City of Sebastian,pursuant to Section 4.07 of the City Charter, adopted Resolution No.R-98-01 on January 28, 1998,specifying Precincts 12, 14, 15 and 16 as the official polling places for the City of Sebastian for the general election, and naming the offices to be filled; and WHEREAS,the City Council affirmed the Canvassing Board for the City of Sebastian on January 28, 1998; and WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.021 of the Florida Statutes,has caused to be published notice of the general election on December 9 and 19, 1997, in the Vero Beach Press Journal, a newspaper of general circulation; and WHEREAS,the City, Clerk has posted notice of the general election on the official announcement board located at City Hall;and WHEREAS,Precincts 12, 14, 15 and 16 of the City of Sebastian,Indian River County, Florida,held a general election on March 10, 1998; and WHEREAS,the Canvassing Board has verified said returns and has found the same in proper form. The assigned number is written on the voided ballot card and on the duplicate (pink) ballot card which should be clearly marked "DUPLICATE." A record of the total number is made in the "Duplicating Board Log." The unclear/uncountable ballot cards are then marked"VOID" and sealed in the Duplicate Board Ballot Card Container provided. The pink duplicate ballot is then placed with the other precinct ballot cards inside the ballot container. The Canvassing Board (Duplication Board) checks each other (and should be of different parties if available in partisan elections) to ensure the accuracy of their work. The Canyassing Board then pass the ballot container and ballot cards on the processing board. • Minutes of the Indian River County Municipal Canvassing Boards Orientation Meeting and Logic and Accuracy Test Thursday, March 5, 1998 - 3:00 p.m. 3rd Floor Conference Room Indian River County Administration Building 1840 25th Street Vero Beach, FL Present: Indian River County: Supervisor of Elections,Kay Clem; County Attorney,Charles Vitunac; Chief.Deputy Supervisor of Elections,Diana Wright;and Absentee Ballot Coordinator,Marg e Trumble City of Sebastian Canvassing Board Members: Chairperson and City Clerk,Kathryn O'Halloran; Councilmember Louise Cartwright; and Deputy City Clerk,Sally Maio City of Vero Beach Canvassing Board Members: City Attorney,Robert Sechen; City Manager,Rex Taylor; and City Clerk,Tammy Vock City of Fellsmere Canvassing Board: City Attorney,Warren Dill;Councilmember Bob Baker; and City Clerk,Deborah Krages Supervisor of Elections,Kay Clem gave a brief presentation,a videotape presentation on canvassing of election results,and an overview of procedures which will be followed on March 10, 1998 relative to absentee ballots,of which she stated a total of 31 had been received so far,and canvassing. She stated that following the opening and certification of absentee ballots,the logic and accuracy test will be conducted,the machines will be certified to be beginning at zero and then one member of each Canvassing Board will remain in the room to view the counting and the other two members will be allowed to move around to view the ballot receiving and inspection. She did state,however,in the event of a spoiled ballot, all three members will need to be brought back together for duplication and signature. She said she felt it was important for Board members to view all aspects of the process. Once counting is completed,Mrs. Clem said the canvassing board members will have to return to the counting room to certify results and the zeroing out of the machines. Absentee ballot guidelines were reviewed(see attached as distributed at the meeting). Mrs. Clem said any ballots that have been received by her staff and are questionable,are put aside for the Canvassing Board to review and approve or reject. Following a question on what defines"address"by Vero City Attorney Sechen,a motion was made by Mr.Taylor that the City of Vero Beach would only accept postal delivery addresses,which would include either street or post office boxes. Mrs. Vock seconded the motion and the motion was passed unanimously by the Vero Beach Canvassing Board. City of Sebastian Canvassing Board member Mrs. Cartwright moved in concurrence with the Vero Beach motion. Mrs. Maio seconded the motion and the motion passed unanimously. The City of Fellsmere made and passed unanimously the same motion. Minutes of the Indian River County Municipal Canvassing Boards Orientation Meeting and Logic and Accuracy Test Thursday,March 5,1998-3:00 p.m. • Page Two City of Vero Beach Canvassing Board member,Mr.Taylor made a motion that the City of Vero Beach accept all guidelines 1-14 listed on the February 14, 1998 memo from Kay Clem(attached),except as amended number 4)No Witness Address. Mrs. Vock seconded the motion and it passed unanimously. City of Sebastian Canvassing Board member Mrs. Cartwright moved in concurrence with the Vero Beach motion. Mrs.Maio seconded the motion and the motion passed unanimously. The City of Fellsmere made and passed unanimously the same motion. Mrs. Clem briefly reviewed procedures for recount,protest of election returns,certification of results,and advised that she had copies of her security procedures if anyone wanted them. The meeting was adjourned at 4:05 p.m. and all members were escorted to the Supervisor of Elections'office for the Logic and Accuracy Test. Mrs. O'Halloran was excused at 4:05 p.m. City of Sebastian Canvassing Board members,Mrs. Cartwright and Mrs. Maio,along with other Canvassing Board members certified the test. INTRODUCTIONS Everyone present for today's meeting introduced themselves by stating their name, their position and the city that they are representing. Review of SOE and Canvassing Board Election Night Procedures Mrs. Clem gave an overview of what they will be doing on election night, as far as the physical layout. She said that they have a total of 31 absentee ballots this year, for all the cities. She said they will open these ballots in the first floor conference room. In the front portion of that room they will be doing the inspection of the ballots and in the very front of that room is where they will be receiving the ballots. Mrs. Clem said that in their manuals they will find the duties of the inspection clerks and the duties of the receiving clerks. Mrs. Clem said as soon as they finish the absentee ballot procedures they will do the pre- election logic and accuracy test. She said one canvassing board member will have to remain in the room where the ballots are being counted. She said the other two canvassing board members can move around. She said she did not think it was right for her to ask the canvassing board members to verify an election if they are not allowed to get out of that room and see what is going on during the election. She said the only thing that she has not figured out logistically is if there is a damaged ballot,that ballot has to be duplicated and all three canvassing board members have to sign it. She said she felt more comfortable with people being spread out watching the entire process. Mrs. Clem said once they have finished receiving and stuffing the ballots, in the first floor conference room, they will be escorted by sheriff deputies. She said they are trying to use sheriff deputies for City elections and City Police for County elections. She then said they will have to go through the signing of all of the paperwork. Mrs. Clem told the canvassing board members that they will all have to stay until all of the Cities are done, because they have to zero out the machine. She said all of the canvassing board members have to sign that they saw that the machine was at zero to begin with. Video Presentation Mrs. Clem told the canvassing board members that there has been a video put together by the Statewide Association of Supervisors of Elections and she is going to show it to the canvassing board members at this time. Absentee Balloting Guidelines Mrs. Clem went over the absentee balloting guidelines with the canvassing board members(see attached). She said all of these decisions will be in their hands. Mrs. Clem explained as absentee ballots come into her office they make sure that they meet all of the applicable requirements. She said if a ballot does not then they put it aside for the canvassing board to look at. Mr. Sechen questioned guideline 4) No Witness Address. He questioned what is an address. He asked if the city and state were enough of the address to accept. After some discussion, Mr. Taylor made a motion that the City of Vero Beach only accept postal delivery addresses, which would include either street or post office boxes. Mrs. Vock seconded the motion and it passed unanimously with Mr. Taylor voting yes, Mrs. Vock yes and Mr. Sechen yes. The same motion was made for the City of Fellsmere and the City of Sebastian and they both passed unanimously. After all of the guidelines were discussed, Mr. Taylor made a motion that the City of Vero Beach accept all of the guidelines (1-14) listed on the February 24, 1998 memo from Kay Clem, headed Absentee Canvassing Board Guidelines except as amended number 4) No Witness Address. Mrs. Vock seconded the motion and it passed unanimously with Mr. Taylor voting yes, Mr. Vock yes and Mr. Sechen yes. The same motion was made for the City of Fellsmere and the City of Sebastian and they both passed unanimously. Conclusion Mrs. Clem told the members that she has a copy of their security procedures for the entire election if anyone would like to view them. Chairperson Kathryn O'Halloran called for a motion to approve the March 4, 1998 Canvassing Board minutes. MOTION by Cartwright/Maio I so move. VOICE VOTE on the motion carried 3-0. Supervisor of Elections staff member,Marge Trumble submitted a list of 45 absentee ballots and one questionable sealed absentee ballot to the Sebastian Canvassing Board for determination, along with a copy of the voter registration form for Harold Brauer,489 Memorial Avenue,Sebastian. The signature on the ballot envelope and the signature on the voter registration form were completely different. The Canvassing Board unanimously rejected the ballot based on Absentee Ballot Guideline#2 (see guidelines approved by all Canvassing Boards at the3/4/98 meeting attached). The rejected ballot will remain on file in the office of the Supervisor of Elections. The list of absentee ballots minus the rejected ballot was 44. Absentee ballot count and review was completed at 6:40 p.m. Minutes of the City of Sebastian Canvassing Board Tuesday,March 10,1998-6:00 p.m. Page Two Canvassing Board members moved to the Supervisor of Elections office for equipment tests. The Sebastian Canvassing Board certified to a Logic and Accuracy test and absentee ballot count which came out to 44. At the completion of this first set of tests,Ms. Maio remained in the counting room during all ballot counts,and Chairperson O'Halloran and Ms. Cartwright moved to the 1st floor conference room to oversee inspection and receiving teams. One ballot was returned by poll workers from precinct 16 in a separate envelope,indicating it needed duplicating. Ms. O'Halloran and Ms. Cartwright were called back to the counting room to make a determination on the ballot. The ballot was opened and determined to be bent. A duplicate ballot was made in accordance with proper procedures and counted with ballots for precinct 16. The bent ballot was marked VOID and filed with the Supervisor of Elections staff. Following the completion of ballot counting for all precincts,the Sebastian Canvassing Board certified to the final results and Logic and Accuracy test. We did not mail to any city political action committees that may be registered with you as I have not been informed that any exist. In compliance with the Florida Election Code and Sunshine Law, we will advertise the orientation meeting of the canvassing board,the Logic and Accuracy test, and the meetings of the canvassing board on March 10, 1998, in the legal advertising section of the Vero Beach Press Journal, the Florida Today and the Sebastian Sun on March 1, 1998. Please proofread the enclosed canvassing board report. If any changes need to be made, please notify us as soon as possible. You will receive a bill for your city's share of the cost of the March 10 election after all the expenses are in and allocated. Settles Subject: Section 2-167 of the Code of Ordinances re Board or Committee Members Date: December 23, 1997 Section 2-167 of the City of Sebastian Code of Ordinances states: ...No member of any city board or committee shall become a candidate for elective political office during his or her term. A letter of resignation shall be tendered to the Office of the City Clerk at least ten(10)days prior to the first day of qualifying for the office he or she intends to seek.... In the event that a board or committee member refuses to resign and becomes a candidate for office, the City Council would have grounds for removal under the City Code of Ordinances. The ordinance does not address the effective date of the resignation. From discussions at the workshop concerning the ordinance, I believe that the City Council's intent was to have the resignation effective immediately, so that a person's role as a board member would not conflict with their campaign efforts. I recommend that, in the event that a board member becomes a candidate for office without resigning, the name(s) be forwarded to the City Council so that the members can decide on the appropriate course of action. I learned quite a lot but the information that really caught my attention is that we can all be held personally liable for our actions as a board. Another highlight of the meeting in my view related to our review of absentee ballots that may fall in the"grey"area. These are ballots that may have an inadequate address of the witness, etc. The general theme proposed by our"experts" was that we decide at the outset whether we will loosely or strictly interpret the law governing this information. It is then extremely important that we stick to that interpretation method throughout our review. The manual is quite lengthy, however, I believe our duties as a Canvassing Board should not be taken lightly.
