CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA ALL PROPOSED ORDINANCES AND INFORMATION ON ITEMS LISTED BELOW MAY BE INSPECTED IN THE OFFICE OF THE CITY CLERK, CITY HALL, 1225 MAIN STREET, SEBASTIAN, FLORIDA. PURPOSE: REVIEW REPORT ON WATER AND SEWER ISSUES Mayor Votapka called the meeting to order at 7:00 p.m. 2. Councilman Oberbeck led the Pledge of Allegiance. 4. ROLL CALL Present: Vice Mayor Robert McCarthy Councilman Frank Oberbeck Councilman Robert McCollum Mayor Richard Votapka Absent: Councilman Lloyd Rondeau (excused) Also Present: City Manager, Robert McClary City Attorney, Charles Nash City Clerk, Kathryn O'Halloran Deputy City Clerk, Sally Maio Mayor Votapka announced that starting April 1, 1989, Channel 35 will carry City Council meetings. REVIEW REPORT ON WATER AND SEWER ISSUES (Re~ort dated 2/15/89) The City Manager reiterated his recommendation as stated in his letter to City'Council dated February 15, 1989 (see attached), and requested authority for staff to begin negotiations with Indian River County whereby the City would act as a catalyst for the County to acquire General Development Utilities Water Franchise, General Development Utilities Sewer Franchise, Sebastian Lakes Utility Company Water and Sewer Franchise, and Lake Delores Utilities Water and Sewer Franchise. Indian River County Commissioner, Doug Scurlock, expressed the County's willingness to work with the City to acquire the franchises and explained methods for financing which have been used in other areas of the County. Mayor Votapka called recess at 8:23 p.m. and reconvened the meeting at 8:37 p.m. Ail members present at recess were present at recall. Buddy Betschart, Division Director for GDU, said the company had no desire to sell the utility franchise to the City. Nelson Hyatt, owner of Park Place (aka Lake Delores), said he is currently negotiating with the County regarding the County's acquisition of its utility franchise. MOTION by Oberbeck/McCarthy I move that the City enter into negotiations with Indian River County whereby the City of Sebastian would serve as the catalyst and vehicle for Indian River County to acquire the systems currently owned by the three (3) private utility companies operating within the City. The City Manager said although GDU is not interested in selling, the City has the ability to compell the sale under the terms of its franchise. ROLL CALL: Vice Mayor McCarthy - aye Councilman McCollum - aye Councilman Oberbeck - aye Mayor Votapka - aye MOTION CARRIED 4-0.
