Box 780127 Sebastian, Florida 32978 Dear Mr. Eckis: We are in receipt of your correspondence of September 9, 1991, on the above -noted matter. With this writing, we will address the two points you raise. The first point addresses the matter of the license agreement under which the crossing is sanctioned. You make the point that your City has not formally accepted responsibility from Indian River County. As resolution of this matter, we will prepare and offer your office a form of License Agreement for handling with your City. The second point concerned the design of the work now planned, and sug- gested the City may wish to seek a proposal from a licensed contractor in the matter of installing the approach pavement materials. In this instance, our work is to rehabilitate an existing at -grade crossing of a railroad in accordance with Florida Department of Trans- portation Department of Highway Standard Index 560, Type T- Modified. The approach paving and marking is to be of materials and workmanship in general accordance with the Florida Department of Transportation Standard Specifications for Road and Bridge Construction. If you wish to evaluate the work of repaving the approaches, you should advise your bidder that the Railway will remove all paving and crossing material in an area the length of the crossing and approximately 8 feet both sides of the centerline of the track. The track will be rehabili- tated and raised approximately 1} inches above the current elevation. We would then reinstall the concrete segments of the road surface. 0 Mr. D. 'C. Eckis, P.E. September-26, 1991 Page two Your contractor's responsibility would be to, at the direction of Railway supervision, install all asphalt materials to reconstruct the roadway surface, to include filling of the volume between the track rails and the crossing slab segments. Of course, the raise in track elevation would require a feathered distance beyond the surface area excavated in the work of removing the construction. We do note that this work is of a small volume of asphalt materials and requires smaller equipment and considerable hand work. We do wish to progress the work in the near future. May I have your authority to bill the City for this needed work, and your election as relates to furnishing and reinstalling the asphalt paving materials. Very truly you s, W. S.
