AGREEMENT
FOR DONATION AND DISPLAY OF PHOTOGRAPHS AND ART
This Agreement entered into q"day of /1�� , 2014 between the CITY OF
SEBASTIAN, 1225 Main Street, Sebastian, FL., 32958, a Florida municipal corporation
(hereinafter called "CITY"), and Charles Clifford Allen a/k/a Chick and his wife Billie
Allen, 218 S. Wimbrow Drive, Sebastian, FL 32958 (hereinafter called "DONORS")
provides that;
WHEREAS, CITY operates Fisherman's Landing in the Stan Mayfield Working
Waterfront- Sebastian,
WHEREAS, DONORS are the owners of copyrighted photographs that they wish
to have displayed for education purposes and to further develop the public interest in
the Sebastian fishing industry; and
WHEREAS, CITY desires to display the photographs to the public;
THEREFORE, IN AND FOR CONSIDERATION of the mutual benefits provided
herein, the sufficiency of which is acknowledged by the parties, it is agreed:
1. DONORS do hereby donate one copy of copyrighted photographs per list
below to the CITY. No publication rights are given or implied without written
permission from Charles Clifford Allen a/k/a Chick Allen.
2. The CITY shall place said photographs on display to the public at the
Fisherman's Landing in the Stan Mayfield Working Waterfront -Sebastian with
an educational plaque identifying and describing the historical significances of
the display pieces.
3. In the event that CITY at a future date, is no longer able to display said
photographs in the Fisherman's Landing in the Stan Mayfield Working
Waterfront -Sebastian, it shall use its best efforts to place said photographs in
a similar museum -like setting for the enjoyment of the public.
4. Any and all reversionary interests held by heirs or successor -in -interest to the
DONORS shall extinguish ten years from the date of this Agreement.
Description of Works by Artist/Photoarapher Chick Allen
(1) 11 X 14 "Coolidge Judah Mending His Net' and other prints to be selected
by Mr. and Mrs. Allen.
