This policy was established to create clear rules and guidelines with regard to employee conduct and responsibilities Purpose: A City employee working full-time has primary employment responsibility to the City. Other employment outside of the City is considered secondary employment. An employee must notify his/her supervisor, annually, before engaging in any secondary employment. The purpose of this policy is to ensure that an employee's secondary employment does not have an adverse effect on the Employee's primary employment and does not create a conflict of interest. AUTHORITY: City employees need to receive authorization from their Department Head and the City Manager to engage in outside employment away from the City of Sebastian. POLICY Before accepting an initial offer of secondary employment, an employee must submit a Secondary employment Request Form and obtain approval for the Secondary Employment by his/her Department Head and the City Manager. A. Employees are discouraged but not restricted from engaging in other employment during their off duty hours. However, City employment shall be considered the primary employment and no employee may engage in outside employment which would interfere with the interest of the City service. B. Any employee desiring to pursue outside employment shall notify their Department Head for approval to engage in outside employment. The request shall state the type of employment and the hours of work, the name of the prospective employer and the place of employment. The request will then be forwarded to the City Manager. C. The City Manager may reject the request if it is deemed to affect City employment. Outside employment previously approved may be cancelled or terminated by the City Manager, upon giving written notice to the employee to whom the permission was granted. D. Employees granted permission to engage in outside employment shall not work at the outside employment for a longer period of time than stated in the request, nor at a different place _ofemployment.thanthat_setforthinthe_request___ E. Any employee accepting outside employment under the terms of this rule shall make arrangements with the outside employer to be relieved from his/her outside duties if and when called for emergency service by the City. Every employee granted permission to engage in outside employment under this rule shall agree to and shall respond immediately to any emergency call to duty by the City whenever the Department Head or the City Manager shall determine his/her services to be necessary. F. Employees sustaining injuries while engaged in outside employment are ineligible to receive benefits under City Workers' Compensation on account of disability resulting from outside employment. G. Equipment, facilities, vehicles or property of the City, shall not be used by employees for outside employment. Also, the City Health Insurer has an occupational exclusion. Injuries sustained during outside employment would need to be reported to your second employer's Workers' Compensation. If employee is self-employed in an outside job, which is located within the City or provide services within the City, the employee is required under City Ordinance to obtain an Occupational License through the Building Department. Any business activity for which an Occupational License would be required is subject to Code Enforcement action should there be no license. Additionally, a conditional use permit for a home occupation may also be required. CITY RESPONSIBILITY It is the City's responsibility to ensure that secondary employment is not permitted when it would: Create either directly or indirectly a conflict of interest with the employee's primary employment; or Have an impact on, or create any possibility of conflict with City operations; or Impair in any way the employee's ability to perform all expected duties, or to make decisions and carry out in an objective fashion the responsibilities of the employee's position. RECORDKEEPING A copy of the signed Secondary Employment Request Form is kept in the employee's personnel file in Human Resources or the Police Department. Employees must report any changes in secondary employment status as they occur by completing a new Secondary Employment Request Form and submitting it to their Department Head and City Manager. Annually, before January I" of each year, affected employees continuing secondary employment must submit an updated Secondary Employment Request Form to their Department Heads and City Manager. An employee's secondary employment is considered public information and may be disclosed to third parties upon request. REVERSAL OF DECISION Withdrawal of Secondary Employment Approval If the Department Head or City Manager believes the secondary employment has caused the employee's overall work performance to drop below a "good" performance level, the Department Head or City Manager must first approach the matter with the employee as a performance issue and provide the employee adequate time to demonstrate improved performance. If the employee's performance does not improve within a reasonable period of time, and if the Department Head continues to believe that the secondary employment is the cause of these performance problems, the Department Head shall speak with the City Manager and Human Resources to decide to deny the employee's secondary employment. The Department Head should allow the employee a reasonable amount of time to give notice of termination to the secondary employer. FAILURE TO COMPLY An employee's refusal to end his/her secondary employment as directed by the policy is considered a matter of personal misconduct and may be subject to disciplinary action, up to and including dismissal. Department Heads should contact the Human Resources Department in such cases. G Outside Employment and Occupational License Policy I, have read this policy and I am aware of its terms and conditions. I have received a copy of the Outside Employment and Occupational License Policy and the Secondary Employment Request Form and I fully understand the terms of this policy and agree to abide by them.
