ANDERSON'S REQUEST FOR A BRIDGE TO BE BUILT ON A PUBLIC EASEMENT FOR ACCESS TO THE GOLF COURSE. VICE MAYOR GASS STATED THAT HE AND THE CITY ENGINEER CHECKED INTO THE ASPECTS OF MR. ANDERSON'S REQUEST REGARDING THE BRIDGE TO BE BUILT ON A PUBLIC EASEMENT, OVER TWO DITCHES TO PROVIDE ACCESS TO THE SEBASTIAN GOLF COURSE. M. ANDERSON HAS AGREED TO PAY THE ENTIRE COST OF THE BRIDGE AND BE COMPLETELY RESPONSIBLE FOR ALL MAINTENANCE. AFTER A BRIEF DISCUSSION, EARL MASTELLER, CITY ENGINEER, STATED THAT HE REQUESTED MR. ANDERSON TO PREPARE A PROPOSAL STIPULATING EXACTLY WHAT HE PROPOSES TO DO. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN SCHUM, THAT WE GO AHEAD AND APPROVE THIS REQUEST, SUBJECT TO PIAN AND SPECIFICATION REVIEW BY OUR ENGINEER AND LEGAL REVIEW BY OUR ATTORNEY. CARRIED. COUNCILMAN VOTAPKA REPORTED THAT HE HAS BEEN IN TOUCH WITH MR. LEE NUZIE, CIVIL DEFENSE, REGARDING ITEMS IN THE CIVIL DEFENSE BUDGET. HE ALSO REPORTED THAT SINCE MR. STRICKER CANNOT ATTEND THE HURRICANE CONFERENCE THAT HE WOULD ATTEND FOR ONE DAY. AFTER CHECKING INTO THE FLUORIDATION PROGRAM AVAILABLE, AS ADVERTISED IN THE FLORIDA MUNICIPAL RECORD, COUNCILMAN VOTAPKA REPORTED THAT THE EXISTING WATER SYSTEM IN INDIAN RIVER COUNTY HAS A NATURAL CHLORIDE CONTENT HIGHER THAN THE MINIMUM LEVEL THAT THE PROGRAM IS INSTITUTED FOR. COUNCILMAN VOTAPKA ANNOUNCED THAT A REPRESENTATIVE FROM THE FLORIDA LUNG ASSOCIATION WILL ATTEND THE NEXT WORKSHOP MEETING, MAY 5, 1982, TO DISCUSS THE CLEAN INDOOR AIR ORDINANCE. COUNCILMAN VOTAPKA REPORTED THAT A CEMETERY COMMITTEE MEETING WILL BE HELD, SUNDAY, APRIL 18, 19 82 , AT THE CEMETERY. HE FELT IF THEY HELD THE MEETING ON SITE THAT THEY COULD GO OVER SOME ITEMS AND OBSERVE EXACTLY WHERE THEY ARE. MAYOR FLOOD RECOMMENDED THAT VICE MAYOR GASS AND EITHER CAPTAIN JOHN MELTON OR THE NEW STREET SUPERINTENDENT ATTEND THE HURRICANE CONFERENCE THAT WILL BE HELD THIS WEEK IN ORLANDO. MOTION BY COUNCILMAN OBERBECK, SECONDED BY COUNCILMAN SCHUM, THAT EVERETT GASS, CAPTAIN JOHN MELTON AND THE HIGHWAY SUPERINTENDENT ATTEND THE HURRICANE CONFERENCE IN ORLANDO. CARRIED. ANDERSON, his wife, will convey a permanent easement to the CITY for the purpose of giving access by the public to the foot bridges hereinafter described, which easement will be located and particularly described in any conveyance of said easement made pursuant to this. agreement., as: The West 5 feet of Lot 38, Block 65, SEBASTIAN HIGHLANDS, UNIT 2, as recorded in Plat Book 5, Pages 34-35, Public Records of Indian River County, Florida. 2. JOHN S. ANDERSON and MARY M. ANDERSON, his wife, represent that they are the sole owners in fee simple absolute of the above described easement and servient estate, and that there are no liens,encumbrances or outstanding claims or judgment-.- against udgment:against said real property, and further, JOHN S. ANDERSON and MARY M. ANDERSON, his wife, will warrant and defend their title to said property against any and all claims thereto, this covenant to run with the land. 3. JOHN S. ANDERSON and MARY M. ANDERSON, his wife, will hold the CITY harmless and indemnify the CITY, for any and all injury which may be caused to the servient estate, or any and all persons or property, by a member of members of the public using said easement. ANDERSON, his wife, will construct a foot bridge, to be used for pedestrian and non -motorized bicycle traffic only, of not more than four €bet in width, on the adjoining CITY real property, commencing at the Northeastern most corner of the servient estate, and running four feet thence West along the North property line of the servient Estate. This bridge will be conveyed to the CITY upon completion, in fee simple absolute. JOHN S. ANDERSON and MARY M. ANDERSON, his wife, will also construct a second foot bridge for pedestrian and non -motorized bicycle traffic only, four feet in width, over the property located north of the Northern property line of the servient estate on CITY property, to be conveyed to the CITY in fee simple absolute upon completion. Both said foot bridges are for the purpose of providing a continuous path of travel from the easement described in Paragraph One herein, to the CITY golf course, to members of the public at large, including JOHN S. ANDERSON and MARY M. ANDERSON, his wife, and JOHN S. ANDERSON and MARY M. ANDERSON, his wife, accept this benefit of their being able to travel from the easement located on the servient estate across the foot -bridges to the CITY golf course as consideration in part for this agreement. 6. JOHN S. ANDERSON and MARY M. ANDERSON, his wife, will maintain the easement located on the servient estate and keep it clean and free from all obstructions, and all hazards which might injure members of the public using such easement, and, should JOHN S. ANDERSON and MARY M. ANDERSON, his wife, in any way fail to maintain this easement, the CITY may maintain the easement and any expense therefor may be charged to the DANIEL M. KILBRIDE, JR. ANDERSON, his wife, the CITY will provide all engineering services for design and construction of the.foot bridges and for the design and construction of any improvements which may be built on the easement to implement pedestrian and bicycle traffic afrer conveyance of the easement to the CITY. 9. This entire agreement is subject to the condition subsequent that the CITY will approve the design of the foot bridges and the design of any improvements which may be constructed on the easement located on the servient estate, prior to commencement of construction.
