AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, VACATING, ABOLISHING, ABANDONING AND DISCONTINUING A PORTION OF PLATTED LAND KNOWN AS t �s A 2 D SEBASTIAN GARDENS SUBDIVISION, SOUTH OF 04 MAIN STREET, SEBASTIAN, FLORIDA. WHEREAS, the applicant Roger n and Wau eta B. Skillman, his wife, have petitioned the City of Sebastian to vacate a portion of a platted subdivision; and WHEREAS, the applicant Roger M. Skillman and Wauneta B. Skillman, his wife, have supplied the City of Sebastian with proof that they are the fee simple owners of the platted land and a certif- icate that the taxes on the platted land have been paid; and WHEREAS, the City of Sebastian's Planning and Zoning commission, on June 20, 1985, approved the vacation of said platted land; and WHEREAS, the City Council of the City of Sebastian, Florida, has no objection to the vacation of said platted land to acreage. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Sebastian, Florida, that SECTION I ALL OF BLOCKS 1 AND 2 AND THAT PORTION OF TRACT D LYING SOUTH OF MAIN STREET, SEBASTIAN GARDENS SUBDIVISION, AS RECORDED IN PLAT BOOK 5, PAGE 58, PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLQEZDA. by vacating that portion of platted land of Sebastian Gardens Sub- division by returning said property, described herein, to acreage. SECTION II This Ordinance shall become effective when the Clerk of the Circuit Court receives and records a certified copy of this Ordinance into the Public Records of Indian River County, Florida. I. ch. 71 JJs;. 61, ch. 73.M3. 177.101 Vacation and annulment of plate subdividing land.— (1) Whenever it is discovered, after the plat has been recorded in the public records, that Lite develo J - or has previously caused the lands embraced in the aecund plat to be differently subdivided under and by virtue of another plat of the name identical lauds, and the first plat was also tiled of public record at at earlier date, and no conveyances of lots by reference to the first plat so filed appears of record in such county, the governing body of Lite county is author- ized and directed to and shall, by resolution, vacate unl anal the firstlat of such lands appearing of re- cord upon the application of the developer of such lands under the first plat or upon application of the owners of all lite lots shown and designated upon the second and subseyuatt plat of such hands, and the circuit court clerk of the county shall thereupon make proper notation of file annulment of such plat upon the face of such annulled plat.
