HomeMy WebLinkAbout1987 - Abandonment of Harrison & Jefferson StreetsORDINANCE NO. 0-87-21 AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ABANDONING THE EIGHTY FOOT RIGHT-OF-WAY OF HARRISON STREET FROM THE EASTRLY-I�DGE OF INDIAN RIVER BOULEVARD TO THE INDIAN RIVER; AND ABANDONING THE EIGHTY FOOT RIGHT-OF-WAY OF JEFFERSON STREET FROM THE EASTERLY RIGHT-OF-WAY OF INDIAN RIVER BOULEVARD TO THE INDIAN RIVER AND FROM THE WESTERLY EDGE OF INDIAN RIVER BOULEVARD WESTERLY EIGHTY-NINE AND EIGHT - TENTHS FEET TO THE SOUTHERLY PROJECTION OF THE WEST PROPERTY LINE OF LOT 15, ED�GEWATER PARR SUBDIVISION; PROVIDING AN N EFFECTIVE DATE. k 0ck-q BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: SECTION .1 The City of Sebastian, Florida hereby abandons the following public streets as specified: (1) The eighty foot wide street called Harrison Street from the easterly edge of the right- of-way of Indian River Boulevard (formerly called Old Dixie Highway) to the Indian River, the same being a distance of 91.15 feet, more or less. (2) The eighty foot wide street called Jefferson Street from the easterly edge of the right- of-way of Indian River Boulevard (formerly called Old Dixie Highway) to the Indian River, the same being a distance of 148.05 feet, more or less. (3) The eighty foot wide street called Jefferson Street from the westerly edge of the right- of- _Y f Ixf iver Boulevard (formerly ld Dixie Highway) � southerly pro ctio of the west property line of lot 15,)brk Edgewater Park Subdivision, as per plat book 1, page 23, Public Records of Indian River County, Florida, a distance of 89.9 feet, more or less. (Edgewater Park Subdivision) My file 87.155 Dear Sirs: I represent the Florida Partnership known as "Good Guys" who purchased the trailer park described in the attached survey. Despite the fact that the survey refers to an abandoned right-of-way on both Harrison Street and Jefferson Street we are unable to locate in the public records the aban- donment. The surveyor's predecessor (Peter Musick) had indicated they were abandoned in prior survey notes. To clarify the 'title to the property and the public records I would request a formal abandonment of Harrison Street and the northern 1/2 of Jefferson Street described as follows: Northern 1/2 of Jefferson Street bounded on the west Southerly projection on the West line of Lot 15, Bleck 11, and bounded on the South by the centerline of 80' right of way extended from its intersection with the projection -of the west line of Lot 15 to the west right- of-way to Old Dixie Highway AND ALSO the North 1/2 of Jefferson Street extending eastward from the East right- of-way of Old Dixie Highway to the edge of the Indian River. I would as soon as reasonably possible request an opportunity to meet with you at a workshop or other meeting to discuss this natter with you. The parcel north of Harrison Street was purchased by the City of Sebastian and upon abandonment of Harrison Street reverts to the abutting land owner, the City of Sebastian.
