RE: License to Utilize ROW / Inadvertent Encroachment
Dear Mr. Kangadis,
Further to our inspection at your address and our subsequent discussions, this is a letter of agreement granting you a
license to utilize the City right-of-way at your address to cover the current situation; i.e. the construction of a retaining
wall inadvertently encroaching 2 to 3 inches into the ROW.
This encroachment license is subject to the following conditions:
1. The encroachment shall, at the sole discretion of the City, be removed by you upon a fifteen (15)
day written notice.
2. You shall be responsible for maintaining the wall in a safe and attractive condition.
3. You agree to indemnify, defend and hold City harmless from any and all claims of any nature
whatsoever arising from the encroachment of the wall into the City right-of-way.
4. All of these conditions shall run with the land and be binding upon your successors -in -interest to
the property.
By signing below, you hereby accept the terms of this license, and agree that you and your successors -in -inter est to
the property shall be bound accordingly.
