R-21-06 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, IN SUPPORT OF HOUSE BILL 1143 AND SENATE BILL 1466 AS FILED IN THE 2021 SESSION OF THE FLORIDA LEGISLATURE; AMENDING SECTION 332.007, FLA. STAT. REVISING THE TYPES OF AIRPORTS TO WHICH FUNDS ARE AVAILABLE FOR ELIGIBLE AVIATION DEVELOPMENT PROJECTS; PROVIDING FOR DELIVERY TO THE INDIAN RIVER COUNTY LEGISLATIVE DELEGATION AND THE FLORIDA LEAGUE OF CITIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, as a general aviation facility, the Sebastian Municipal Airport recognizes and appreciates the benefits of receiving funding from Federal and State sources; and WHEREAS, Florida Department of Transportation (FDOT) funds airport capital improvement projects at general aviation airports at 80% of project cost; and WHEREAS, under current State law, when a general aviation airport begins to receive scheduled commercial airline service in excess of 10,000 annual commercial passenger enplanements, the airport is classified as a primary Commercial Service Airport by the Federal Aviation Administration and FDOT, which reduces FDOT funding eligibility from 80%to 50%; and WHEREAS, the Commercial Service Airport designation remains in effect even if annual commercial passenger enplanements falls below 10,000; and WHEREAS, the reduced project funding puts smaller commercial service airports such as neighboring Vero Beach Regional Airport at a financial disadvantage in that revenue from airline operations is far from sufficient to make up the loss in FDOT funding; and WHEREAS, HB 1143 and SB 1466 would amend section 332.007, Fla. Stat. to allow Vero Beach Regional Airport to remain a general aviation airport and not be subject to the reduced grant contributions caused by the threshold of 10,000 enplanements per year; and WHEREAS, the residents of the City of Sebastian and the general public benefit from having access to a safe, well -maintained airports in the local region. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: Section 1—Adootion of"Whereas" clauses. The foregoing "Whereas" clauses are hereby adopted and incorporated herein as forming the legislative findings, purpose, and intent of this Resolution. Section 2 — Sunoort for Adootion of HD 1143 and SB 1466. The City Council supports the adoption and passage of HB 1 143 (by Representative Grall) and SB 1466 (by Senator Hutson) in the 2021 session of the Florida Legislature, and extends its appreciation to the local legislative delegation for its support and assistance. Section 3 — Conflicts. All other resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 4 — Providing For Severabilitv. In the event a court of competent jurisdiction shall hold or determine that any part of this Resolution is invalid or unconstitutional, the remainder of the Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this Resolution without said invalid or unconstitutional provision, thereby causing said remainder to remain in full force and effect. Section 5 — Scrivener's Errors. Sections of this resolution may be renumbered or re - lettered and corrections of typographical enters which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of further action of the City Council by filing a corrected copy of same with the City Clerk. Section 6 — Effective Date. This resolution. shall take effect immediately upon adoption.
