R-21-16 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PURSUANT TO SECTION 125.01(5) (a), FLORIDA STATUTES, GRANTING APPROVAL TO THE INCLUSION OF THE INCORPORATED AREAS OF THE CITY OF SEBASTIAN WITHIN THE PROPOSED CHILDREN'S TRUST DISTRICT, A DEPENDENT SPECIAL TAXING DISTRICT OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in order to establish a special district countywide, IAW Section 125.01(5) (a), Florida Statutes, the special district would be subject to the approval of the governing body of the incorporated area affected. Thus, the City of Sebastian City Council will need to approve the special district in order to have the millage rate applicable in the incorporated areas of the City of Sebastian, if approved by referendum. WHEREAS, Indian River County's children need enhanced services; and WHEREAS, the City Council has taken action to formally recommend to the Indian River County Board of County Commissioners to hold a referendum on the creation of the Children's Trust District with the authority to levy an ad valorem tax to support authorized Children's Trust; and WHEREAS, investing in developmental and educational resources for children and families will provide measurable returns for our community; and WHEREAS, the City Council of the City of Sebastian determines that it is in the best interests of the health and well-being of our children and broader community to be included in the Children's Trust District, subject to the approval by the voters of Indian River County. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTAIN, INDIAN RIVER COUNTY, FLORIDA, THAT: Section 1. APPROVAL. The City Council of the City of Sebastian, Indian River County, Florida, hereby approves the inclusion of the incorporated area of the City of Sebastian within the proposed Children's Trust District, a dependent special taxing district, subject to the approval by the voters of the Indian River County. Section 2. SEVERABILITY. In the event a court of competent jurisdiction shall hold or determine that any pan of this resolution is invalid or unconstitutional, the remainder of the resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this resolution without said invalid and unconstitutional provision thereby causing said remainder to remain in full force and effect. Section 4. SCRIVENER'S ERRORS. Sections of this resolution may be renumbered or r lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of further action of the City Council by filing a corrected copy of same with the City Clerk. Section 3. EFFECTIVE DATE.
