S. tit Sebastian, Florida Dear Mr. Bevan: I represent Mr. and Mrs. Thomas, who have a house located at '102 Schuman Drive, Sebastian, Florida. They own the lot be Add them which is on Manly. I understand that you have startod construction on the lot adjacent to their rear yard lot and obtained a variance from the City of Sebastian to construct the house seven and one-half feet(7 1/2)from the property line, instead of the required ten feet (101). Since the adjacent lot is owned by Mr. and Mrs. Thomas, I feel that they are required to have had notice concerning the obtaining of a variance for construction closer to the property line than is required by ordinance. I direct your attention to Florida Statute 176.13 which requires that notice be given to Interested parties as well as the public, and I have been ad- vised that Mr. and Mrs. Thomas did not have any notice of your attempt to obtain this zon ng variance. They do not feel that the construction of a home closer to their property line is in order, and I would appreciate your contacting me at your earliest convenience to forestall further steps on their part. Mr. William Bevin Page 2 Cetober 5, 1973 We will be reasonable concerning this variance, but I do feel that your action in obtaining a variance without notifying them directly of your attempt to obtain the variance has prejudiced them. Please contact me at your earliest convenience. Very truly yours, 70..ES, PAPiIE a FOSTER, D.A. By George !i. Noss GrIM/jhp cc: Mr. Larry Hall Mr. and Mrs. J ohn C. Thomas JONES. PAINS 6 FOSTER. P.A.
