Vocelle, City Attorney City of Sebastian Vero Beach, Florida 32960 Dear Buck: I am enclosing copies of correspondence to the Board of Adjustment from Mr. Thompson regarding a variance on his lot in Sebastian High- lands, The Board of Adjustment met this morning and tabled the motion un- til some questions could be answered. First, we were not certAin that an aluminum carport awning was a buildinf,• We would ask that ^ clarification be issued by you, also, as to whether we could re- strict our variance to the aluminum awning and any permanent structure be prohibited from being built on the particular concrete driveway by Mr. Thompson or future owners. We also would like an opinion as to whether we have the power to bind future Boards by our action as to the type of structure being erected. The second matter regards notice of meetings of the Board of Adjust- ment. Previously we have been mailing a notice to the members and posting 5 notices in public places in the City. However, there is some question in my mind as to whether or not we should advertise in the newspaper regarding meetings of the Board of Adjustment. I would also appreciate your giving me a call so that we may discuss other matters which are pending concerning the Airport Leases and the Board of Adjustment. _ Sincerely yours, Larry T. Hall, Chairman Board of Adjustment LTH: dj Enclosure GENERAL DEVELOPMENT CORPORATION June 8, 1973 Mr. Larry Hall, Chairman Sebastian Variance Committee Sebastian River Bank Sebastian, Florida 32958 Dear Larry: As per our recent conversation, when we sold the homes for Lots 33 & 36, Block 411, Unit 9, Sebastian Highlands we did not think that it would be necessary to request a variance as the front footage on both lots is over 81 feet. However, when we received the enclosed Engineering Site Plans back, we noticed that we over- looked the fact that each lot narrows in the back. Both of these homes have four bedrooms and should fit in very well across from the park. Therefore, we are requesting a variance on these two lots so that we might obtain our building permits and start construction immediately. We would appreciate your earliest consideration and reply. No. 1 Sebastian, Florida 32958 Dear Bill: The Board of Adjustments at their June 19th meeting approved the side lot setback requirement variance for Lots 33 and 36, Block 411, Unit 9, Sebastian Highlands to construct said residence on lots as per your survey and plot plan. .As you will recall from peal' letters, the Board in granLing this variance is not committing itself to any future variances and again asks that General Development continue to take sLeos to construct houses that will conform with the existing setback requirements without asking for variance. on future lots. Florence Phelan, City Clerk 00% MINUTES BOARD OF ADJUSTMENT JUNE 19, 1973 8:30 A.M. - THE SEBASTIAN RIVER BANK SEBASTIAN, FLORIDA The meeting was called to order by Chairman Larry T. Hall at 8:30 A. M. Present were: Members Betz, Pottinger, Hall. Absent were Members Mays and Broyles. The first item of business to come before the committee was a letter received from John Mays asking that his resignation be accepted as he was no longer a resident of the City of Sebastian. Upon motion duly made and seconded, the Board accepted Mr. Mays resignation with deep regrets. The chairman was instructed to forward his resignation to the City Council, asking that they accept his resignation with regrets and that a letter of appreciation be forwarded to Mr. Mays for his service on the Board. The Board also considered a request from General Development Corporation for a side lot variance on Lots 33 and 36, Block 411, Unit 9, Sebastian Highlands to construct residences on the lots leaving less than the ten foot set back side lot requirements. Upon motion duly made and seconded, the Board approved the request by General Development Corporation since these lots should have been included in the last request, and they have made an effort to replat certain sections to accomodate the large houses. The Board upon motion duly made and seconded reconsidered the requests from Mr. John W. Thompson to construct an awning over his concrete drive- way to within inches of the lot line. Upon motion duly made and seconded the Board approved this variance with the stipulation that the variance is granted for an aluminum awning and the variance in no way grants per- mission to construct a permanent type enclosure over the concrete drive- way now or at any future date. The variance will be effective upon the receipt, by the Board of Adjustments, of a letter from the purchaser of the Gulley property, located immediately to the north, stating that he has no objections to this awning being constructed. There being no further business to come before the Board, the meeting was adjourned.
