A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, AUTHORIZING THE CITY MANAGER TO
EXECUTE A NON-EXCLUSIVE EASEMENT WITH FLORIDA POWER
AND LIGHT (FPL) PROVIDING ELECTRICAL SERVICE TO A SEWER
LIFT STATION LOCATED NEAR 505 AIRPORT DRIVE WEST ON
SEBASTIAN MUNICIPAL AIRPORT PROPERTY; PROVIDING FOR
CONFLICT; PROVIDING FOR SCRIVENER'S ERRORS; AND
PROVIDING FOR AN EFFECTIVE DATE.
Whereas, Florida Power and Light (FPL) requires an easement to provide power
to the sewer lift station near 505 Airport Drive West on Sebastian Municipal Airport and
Whereas, the City of Sebastian agrees to the non-exclusive conditions an
easement,
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, as follows:
Section t. AUTHORIZATION. The City Manager is hereby authorized to
execute said non-exclusive easement with Florida Power and Light Company on behalf
of the City.
Section 2. CONFLICTS. All resolutions or parts of resolutions in conflict
are hereby repealed.
Section 3. SCRIVENER'S ERRORS. Sections of this resolution may be
renumbered or re -lettered and corrections of typographical errors which do not affect
the intent may be authorized by the City Manager, or the City Manager's designee,
without need of further action of City Council by filing a corrected copy of same with the
City Clerk.
Section 4. EFFECTIVE DATE. This resolution shall take effect
immediately upon its adoption.
The foregoing Resolution was moved for adoption by Council Member
MCPartlan

upon put to a vote, the vote was as follows:

The undersigned, in consideration of the payment of $1.00 and other good
and valuable consideration, the ads us and receipt of which is hereby
acknowledged, grant and give to Flor2a Power & Light Company, its
affiliates, licensees, agents, successors, and assigns ("FPL")t a non-
exclusive easement forever for the construction, operation and maintenance
of underground electric utility facilities (including cables, conduits,
appurtenant equipment, and appurtenant above -ground equipment) to be
installed from time to time; with the right to reconstruct, improve, add to,
enlarge, change the voltage as well as the size of, and remove such facilities
or any of them within an easement described as follows:
See Exhibit "A" ("Easement Area")
Together with the right to permit any other parson, firm, or corporation to attach or place wires to or within any facilities
hereunder and lay cable and conduU within the Easement Area and to operate the same for communications purposes; the
right of ingress and egress to the Easement Area at all times; the rigght to clear the land and keep NO
of all Vees,
undergrowth and other obstruc8ons within the Easement Area; the fight to trim and cut and keep trimmetl antl cut all deatl,
weak, leaning or dangerous trees or limbs outside of the Easement Area, which might interfere with or fall upon the lines or
systems of communications or power Vansmission or disbibution, and further grants, to Ne fullest extent the undersigned has
the power to Brent, it at all, the rights hera nabova granted on the Easement Area, over, along, under and across the roads,
sveets or highways adjoining or through saitl Easement Area.
