RESOLUTION NO. R-23-12
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY,
FLORIDA, VACATING A PORTION OF AN EASEMENT ON LOT 12, BLOCK
488, SEBASTIAN HIGHLANDS UNIT 15; PROVIDING FOR CONFLICTS
HEREWITH; PROVIDING FOR RECORDING; PROVIDING FOR
SCRIVENER'S ERRORS; PROVIDING FOR EFFECTIVE DATE.
WHEREAS, Donna ICrulikowski, owner of the land at 482 Anne Terrace, Sebastian, Florida, has
filed a request for a partial abandonment of the public utility and drainage easement along the side lot line
of the site; and
WHEREAS, the providers of telephone, electric, cable, water, and drainage utilities have all
consented to abandonment thereof.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, as follows:
Section 1. VACATION OF EASEMENT. The City Council of the City of
Sebastian does hereby vacate, abolish, abandon and discontinue all of that portion of land previously
dedicated for a public utility and drainage easement described as follows:
The northernmost six (6) inches of the twenty (20) foot public utility and drainage
easement located on Lot 12, Block 488, Sebastian Highlands Unit 15, less the
easternmost ten (10) feet thereof.
Section 2. CONFLICT. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
Section 3. RECORDING.This resolution shall be recorded in the public records of Indian
River County, Florida.
Section 4. SCRIVENER'S ERRORS. Sections of this resolution may be
renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be
authorized by the City Manager, or the City Manager's designee, without need of further action of the
City Council by filing a corrected copy of same with the City Clerk.
Section 5. EFFECTIVE DATE. This resolution shall take effect immediately upon its
adoption.
The foregoing Resolution was moved for adoption by Councilmember lid . The
motion was seconded by Councilmember MCPartlarl and, upon being put into a vote, the vote
was as follows:
