R-02-12 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL ELECTION; PROVIDING FOR CANVASSING OF ELECTION RETURNS;PROVIDING FOR DECLARATION OF RESULTS; DIRECTING THE CLERK TO ENTER THE RESULTS OF THE ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF THE CITY COUNCIL; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,former Vice Mayor Ben Bishop,whose term would have expired in March 2003,vacated his City Council seat on September 26, 2001, and pursuant to Section 2.08(c) of the City Charter, City Council appointed a successor to fill that seat until the seating of a successor elected by the electorate of the city at the next general municipal election to be held March 12, 2002; and WHEREAS, in addition to the two (2)two (2)year terms to be filled in even numbered years, the vacant one (1) year term was added to the ballot. WHEREAS, pursuant to Section 4.05 of the City Charter, the Mayor issued a Proclamation on December 12,2001,calling a general election for March 12,2002,for the purpose of selecting three(3)City Council members; and WHEREAS, the City Council, pursuant to Section 4.07 of the City Charter,adopted Resolution No. R-01-85 on December 12,2001, specifying Precincts 12, 14, 15 and 16 as the official polling places for the City of Sebastian for the general election, naming the offices to be filled; and authorizing the Supervisor of Elections to administer the election; and WHEREAS, the City Council amended Resolution No. R-01-85 by adoption of Resolution No. R-02-04 on February 13, 2002 to reflect changes to two of the four polling places; and WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.021 of the Florida Statutes, published notice of the general election on December 21, 2001, and January 4, 2002 in the Vero Beach Press Journal, a newspaper of general circulation and advertised the polling place changes on February 17, 2002; and WHEREAS,the City Clerk has posted notice of the general election on the official announcement board located at City Hall; and WHEREAS, Precincts 12, 14, 15 and 16 of the City of Sebastian, Indian River County, Florida, held a general election on March 12, 2002; and WHEREAS,the City Canvassing Board has verified said returns and has found the same in proper form. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, • INDIAN RIVER COUNTY, FLORIDA,that: SECTION 1. DECLARATION. All candidates, political party representatives, Canvassing Board members and the media are invited to witness the test. The Code also requires us to advertise this test in our local newspaper. The test will be conducted in our office on March 5, 2002 at 4:30 p.m. We are located in the County Administration Building, 1840 25th Street, Vero Beach, Florida. Absentee ballots for the Municipal Elections received prior to March 12th will be available for public inspection in the Supervisor of Elections Office from 8:30 a.m. until 12:00 noon, March 12th. The Canvassing Board will convene at 5:00 p.m. on March 12th to examine and open absentee ballots in the First Floor Conference Room "A". Any absentee ballots received on Election Day will be available for public inspection at this meeting. At approximately 6:00 p.m. another Public Test is conducted immediately prior to counting the absentee ballots. The Canvassing Board remains convened until all ballots are counted, a final Pubic Test is conducted, and all necessary paperwork is signed. Maio City Clerk RE: Change in Polling Places Based on a newspaper article I read in today's Press Journal referencing the finalizing of City of Sebastian polling places by the Supervisor of Elections, I called that office and was informed that the former precinct 15 which was the North County Library has been moved to the United Church of Sebastian UCC at 1251 Fellsmere Road (Sebastian Boulevard) while the library undergoes renovation; and, that the name of precinct 14 was changed from Highlands Chapel Church of God to Word of Life Church of God(same address). We adopted Resolution No. R-01-85 in December which designated offices to be filled, listed polling places, authorized advertisement of the election, and authorized the Supervisor of Elections to administer the election. The polling places listed in the resolution and the subsequent election legal ads were valid at that time but are now no longer valid. What do we need to do to correct this? Do we need to re-adopt the resolution and run the election ads again or can we clarify the polling places in a display ad? Let me know as soon as possible so I can take care of it. Apparently in the past the qualifying date was construed to be the first date on which a person could begin a campaign. There are traditionally three steps to a candidacy — declaration of candidacy, opening a campaign account and fund-raising, and qualifying. Sometimes people actually fund-raise before declaring their candidacy; this is the "exploratory" committee stage. These three steps can be taken independently of one another. A citizen of Sebastian may declare their candidacy at anytime. At any time they may appoint a campaign treasurer and open a campaign account, an they may thereafter begin fund-raising subject to the reporting provisions of F.S. 106.07 Within ten (10) days of opening the account, that person must file his statement concerning the comprehension of Chapter 106. All of this may be done at anytime prior to qualifying. The only action that is time-restrained is qualifying itself. I hope this answers any concerns on the matter. City Clerk RE: Running for Office The City Attorney provided me with a legal opinion on the question of when a candidate can begin his/her campaign. That opinion was copied to City Council members. As an addendum to the opinion, I am providing information that I submitted to him in making the inquiry. It further explains procedure for anyone who wishes to begin fundraising prior to the January filing period that is set out in the City Charter. To synopsize: • You may simply announce your intention to run at any time and no forms submittal is required until January if you do not wish to begin fundraising until that time. • You may declare at any time and begin fundraising IF YOU HAVE FIRST SUBMITTED TO THE CITY CLERK (qualifying officer) THE FORM NAMING THE TREASURER AND DESIGNATING A CAMPAIGN DEPOSITORY. Within ten days of submitting that form you must submit the form that states you have read and understand FS 106. Campaign reports will have to be submitted on the 10th day of each calendar quarter following the time the form naming the treasurer and depository is submitted and then on the 18th and 4th days preceding the election. • You may wait until the Charter designated filing period in January to submit all qualifying forms if you wish and then only the 18th and 4th day campaign reports are required. • Campaign signs cannot be posted until 30 days prior to the election. In past years, no candidate has ever submitted any of their qualifying papers prior to the 45-60 day period set out in Charter Section 4.02. Charter Section 4.02 Filing of candidate's oath;fee reads; (a) Each candidate, in order to qualify for election to the office of councilmember, shall take and subscribe to an oath or affirmation in writing. A printed copy of the oath or affirmation shall be furnished to the candidate by the city clerk and shall comply with the provisions of Florida law. (b) The oath set forth above in subsection (a) shall be filed with the city clerk at least forty-five(45) days, but no more than sixty(60) days,prior to the day of the election, along with payment of a non-refundable filing fee as provided by law. Charter Section 4.01.Adoption of state election laws provides that: All general laws of the State of Florida, relating to elections and the registration of persons qualified to vote therein which are not inconsistent with the provisions hereof or the ordinances of the City of Sebastian, shall be applicable to all city elections. Since there are no other provisions of the charter that relate specifically to qualifying,with the exception of the $25 qualifying fee which is set out in Section 38-2 of the Code of Ordinances, we then turn to the Florida Statutes for additional procedures and schedules for elections filing. Section 106.011(16) F.S. states: "Candidate"means any person to whom any one or more of the following apply: 1. Seeks to qualify for nomination or election by means of the petitioning process. 2. Seeks to qualify for election as a write-in candidate. 3. Receives contributions or makes expenditures, or consents for any other person to receive contributions or make expenditures, with a view to bring about his or her nomination or election to, or retention in, public office. 4. Appoints a campaign treasurer and designates a primary depository. 5. Files qualification papers and subscribes to a candidate's oath as required by law. Section 106.021 F.S. states: No person shall accept any contribution or make any expenditure with a view to bringing about his or her nomination, election, or retention in public office, or authorize another to accept such contributions or make such expenditure on the person's behalf, unless such person has appointed a campaign treasurer and designated a primary campaign depository. This process is done by filing a form provided by and returned to your qualifying officer(city clerk) No where does statutes provide when this designation may take place. Section 106.023 F.S. Statement of Candidate in part states: Each candidate must file a statement with the qualifying officer within 10 days after filing the appointment of campaign treasurer and designation of campaign depository, stating that the candidate has read and understands the requirements of this chapter Section 106.07 F.S.Reports;certification and filing states: (1) Each campaign treasurer designated by a candidate or political committee pursuant to s. 106.021 shall file regular reports of all contributions received, and all expenditures made, by or on behalf of such candidate or political committee. Reports shall be filed on the 10th day following the end of each calendar quarter from the time the campaign treasurer is appointed, except that, if the 1ch day following the end of a calendar quarter occurs on a Saturday, Sunday, or legal holiday, the report shall be filed on the next following day which is not a Saturday, Sunday, or legal holiday. Quarterly reports shall include all contributions made during the calendar quarter which have not otherwise been reported pursuant to this section. (a) Except as provided in paragraph (b), following the last day of qualifying for office, the reports shall be filed on the 32"d, 18th, and 4th days immediately preceding the first primary and on the 1$h and 4th days immediately preceding the second primary and general election, for a candidate who is opposed in seeking nomination or election to any office, for a political committee, or for a committee of continuous existence. (b) (does not relate to municipal officers) In response to the question I would say the options are: • A person can verbally announce that he/she is considering running for office at any time as long as he/she is not taking any contributions or making any expenditures and can wait for the January filing period set out in the Charter to submit the appointment/designation form and all other filing forms and fees. OR • A person can announce that they are considering running for office at any time and begin to take contributions and make expenditures at any time if they have first submitted the form naming a treasurer and designating a campaign depository to the qualifying officer(city clerk). Once the designation form is submitted they would have to, within ten days, submit a form stating they have read and understand FS 106. Campaign Treasurers reports would then be filed on the 10th day following the end of each calendar quarter from the time the campaign treasurer is appointed and then again on the 18th day and 4th day preceding the election). The candidate would submit the remainder of forms and fees necessary to the filing process during the January time slot as set out in the charter. I had asked this same question of other City Clerks and Supervisor of Elections staff during preparation of the election packet for this past year and was told without any hesitation that a person can start the process at any time if they follow the above requirements. As to the posting of signs, in accordance with the Land Development Code, no signs can be posted more than 30 days prior to the election.
